Default @MHM : Can a person with criminal record appear in the exam?

can you tell if a person has some criminal record in that case whether he/she can appear in the exam or not as you are lawyer too.The case is that I was convicted for possession of illegal weapons but only fine was incurred upon me and it was a sum of 2000 Rs which is nothing as compared to the actual/recommended sentence.I think I was released not convicted and can you tell that as I was fine it means that I was convicted and so I cant sit in the CSS exam kindly reply as soon as possible.

Hopefully Mr Maneka or Mr Awan will guide you better as they are better lawyers but here are my two cents. Were you fined by court? (asked by Magistrate to pay the fine in the courtroom). If so then you must have signed a paper or bunch of papers inside the courtroom. That is called confession statement which means that you confessed that you are liable for the criminal act for which you are nominated in FIR and you are willing to pay the fine ordered by the court provided that you wont do it again.

In the above scenario you are convicted, now coming to your original question that are you eligible for the exams or not? i really don't know the answer, some experienced member will guide you better.

BTW were you convicted under 13/20/65?

It seems you were convicted under 13 AO for which the penalty is fine or imprisonment or both. Normally, if you don't have a riminal record before, the judge would issue you a small fine and one day imprisonment. Remember the case of Shaikh Rashid Ahmad vs the state known as Kalashinkov case. The sentence itself is 7 years imprisonment but the judge normally issue a small sentence like in your case. Since you were convicted, that serves as a criminal record on your name and unless you clear your name in a trial court, you are not eligible to apply for any government post. My suggestion to you is to speak to a lawyer and discuss re-opening of the case and produce a license if you had any. Remember,this was a bailable offense and you could have bailed out easily and contested your case. Always remember that it is your legal right to have a solicitor every time you are arrested. Police in this case of yours, must have told you not to worry and confess infront of the judge, so that you get the minimum sentence,but in reality they ruined your entire career.
