Something should be done to claim it by qualifiers.Nothing is at stake so there is no wrong in moving the courts.

The Chief Justice,

Supreme Court of Pakistan

Islamabad.

SUBJECT: SUBMISSION FOR ALLOCATION OF VACANT POSTS IN CSS GROUP OMG ON ACCOUNT OF QUALIFYING CSS RATHER THAN DEPUTATIONISTS AND POLITICAL FAVORITES.
Honourable Sir,

“No citizen otherwise qualified for appointment in the service of Pakistan shall be discriminated
against in respect of any such appointment on the ground only of race, religion, caste, sex,
residence or place of birth (Article 27 of the Constitution).”

It is submitted that I qualified CSS examination 2008 but I could not be allocated to any CSS group because my merit number was short of the seats which were available at the time of
allocations. It was my last attempt of CSS and I lost all chances to enter into civil service of Pakistan.But very recently, I have learnt from news items (copies enclosed) that there were vacant seats
to the tune of 400-500 in office management group against 2/3rd quota of CSS officers, but Establishment Division only offered 50 seats for allocation. It is crystal clear that these seats were filled by deputationists, who were illegally deputized against section 10 of civil servants Act 1973.Majority of these deputationists were not even civil servants are were teachers etc.
So application of Section 10 on them was illegal. Now as per news item, the outgoing Prime Minister approved a summary on 16-3-2013 for induction of these people in office management group (OMG).It is clear that these people were brought to federal secretariat because of their political connections and Establishment Division did not show these seats for allocations in CSS
and it was malafide rather than promotion of merit.

According to Occupational Groups Probation, Training and Seniority Rules 1990,

Occupational Group/Service is one recruitment to which is made in grade 17 by
competitive examination conducted by FPSC from time to time.

It is very clear that I alongwith other CSS qualifiers in 2008 to 2011 were discriminated, despite
being qualified for allocation, on account of our birth in a poor family and for not having
connections with political elite of the last government.

Therefore, it is requested that I alongwith other CSS qualifiers may be allocated against CSS
quota in OMG and the people who are being inducted without passing CSS may be sent back to
their original postings.

I hope justice will prevail and we will get our due right.

03336819770, he is the petitioner in 284 inductions case Mr.Mazhar Hayat.He might be helpful. But you people will have to try for this. You will not lose anything rather there are chances of achieving something.

How one can proceed? To write an application to establishment division first or what?

Syeda Bukhari, write to Human rights cell supreme court with cuttings of newspapers, also copy to secretary establishment.Thats what most of the people are doing. You have to choose the way you deem appropriate.

Default Two petitions received for response

Two petitioners have filed petitions for allocation uptil now and supreme court has sought response from Establishment Division.Establishment Division is on weak footings as illegal inductions are not justified and shortage of officers can not be used as excuse as there were 100s of CSS qualified who could not be allocated.

Default Not a difficult task---only courage needed

DEARS,
Courts are very sympathetic these days. They often bail out the meritorius petitioners. Let make a try. It will be a constitutional petition. As after qualifying CSS, you have been deprived of your basic right of selection. As, the seats were available but not offered to you. The only motive behind this discrimination was to accomodate the politically backed deputationists, as mentioned in earlier threads.
The procedure is not so complicated. Collect few CSS qualified candidates of 2008-11. Go to a lawyer for advice. The lawyer should be expert in service matters. Renowned names in Islamabad are Fiaz Jandraan, Abdul Raheem Bhatti and Shoaib Shaheen. They will give advice free of cost. However, their case fee ranges from 1to 2 Lac. 20-50 candidates can manage it easily.
One thing more, it is high time to go to court and to get relief. Late comers will only have ifs in their life.
