essay preparation by converting urdu columns into English
i am starting an activity of converting urdu columns into english. at first i have translated Najam Sethi column into english Seniors are requested to evaluate it. i shall be thankful to you.
Need For Balance of Power Between Judiciary And Executive In recent days it is feared that intervention by judiciary in different matters can cause long term consequences on Pakistani state and society. Supreme Court has ordered PML (N) government to establish and conclude high treason case against General (R) Pervez Musharraf as early as possible. Principally it should be the right of parliament and executive to do such big and important decisions but the question to be considered is whether the judiciary can force government in such matters? Constitutionally parliament makes laws and prime minister and government make sure its implementation. If someone is to be punished, law will be made by the parliament, prime minister activates the executive and judiciary will decide the case. In spite of these four elements have made Pervez Musharraf cases more complicated. Firstly this case will be consider with point of view that supreme court is going to punish such a person who intervened in its affairs in the past. Secondly it is in the interest of government that it would not unsecure the civil military relations in future. Thirdly due to this case an impression came that Supreme Court want to take action against one person and not the military command as a whole which takes decision with mutual consultation. Fourthly it seems that all the concentration by supreme court is on the 3rd November 2007 events instead of October 1999. It is important to consider that in past supreme court just have a rolling in such political matters. For example in 70’s Bhutto government appealed before supreme court that “treason” should be defined by the court as his government wants to ban National Awami Party (NAP). Traditionally it is right of the government that budget recommendations are considered implemented as the same day as these are announced in the parliament. But Supreme Court has directed the government to implement it after discussion and approval of parliament. By ordering this Supreme Court has bulldozed 1931 act. According to this act parliament can endorse the right of tax collection to government on temporary basis. In all democratic countries this tradition is observed and no one has raised their concerns against it. The purpose of this act is to discourage opportunists, who try to get undue benefit between the law announcement and its approval period. In this case due to this decision, treasury has suffered loss of Rs. 10 Billion rupee due to low tax collections. And loss of difference of announced import duty and collected import duty on old rate is separate from that Rs. 10 billion loss. Due to this if in review petition this decision is not taken back, the government policy about economy will be challenged in future and international accords will also be affected. Now Supreme Court is also going to take review of army act 1952. According to this act high court is not authorized to take cases against army personnel and citizens who came under jurisdictions of this act. Under this act if army has imprisoned any army or civilian personnel, high court cannot interfere in this case. And police also cannot imprison any army personnel, If it do so it had to handover him/her to army. Supreme Court can only take these cases when these are of public interests and when some basic human rights are violated. It is dangerous because Balochistan “missing person case” case come under the jurisdiction of public interests. In spite of the time from when armed groups, separatist and terrorists have started their activities in all over the country, this matter has become more dangerous. Because Supreme Court takes these elements in context of public interest and human rights. But on the other hand army considers it appropriate to crush such elements by using all state means treating them anti state actors. Now the problem is that if this “Army Act” is softening, it will open ways to terrorism and separatism. And if it is not soften it is feared that it can be misused for political victimization. Supreme Court is also having an eye on appointments and transfers of government officials and professional experts. In fact an order has been issued to the government to form a committee of well repute independent persons which will look whether higher posts are filled with capable persons or not. In past executive performed functions according to their own wishes and no one objected them but in these days it is not the same case. It is necessary that a balance should be developed between people interests and governments priorities. Same is needed in the case of legislatures and the judiciary. |
