Today I recieved a letter from FBR regarding my appointment in BPS 17 in Income Tax department. The letter also contains terms of appointment rules etc.it has been directed that I send my acceptance before 28th of September.

Post Appointment letter

I also got the same letter yesterday. Now the confusion is that should we send two letters one to ITG and other to IRS? Second we are supposed to send two letters in response to the appointment letter. One to the undersigned and other to the DG CSA. It's mentioned in the letter. I hope I'm getting it right. Please comment.

I have sent one letter to FBR and and another to DG civil services academy but i am still confused about sending a fax or letter regarding IRS. I mean if we were to send in a choice we would've been informed via mail as we'r not in service as yet and still in preliminary stages.Even our letters say that we have been selected for Income Tax Group.

as rightly said by dual personality, 37th commoners need to exercise their option regarding IRS
as per Mr Mumtaz's contention of not being in service as yet, FBR is collecting option for IRS from those officers who do not fall on the seniority list as of now, i checked this from an official in FBR
so you send this option, if you feel like joining IRS

ISLAMABAD: Customs and Excise Group (CEG) officers have challenged in the Lahore High Court (LHC) the creation of Inland Revenue Service (IRS) in the Federal Board of Revenue (FBR) by the Establishment Division that has asked the CEG officers to submit irrevocable options for inclusion or otherwise in the IRS.

The officers of grade 21 to 17 that signed the petition filed with the LHC Rawalpindi bench, dubbed the office memorandum arbitrary, illegal and unreasonable. The petition will come up for hearing on Monday.

Of the total 436 CEG officers working at different stations of Pakistan, 52 have signed the petition, one of them said and made a copy of the petition available to The News.

They argued that IRS creation would adversely affect the CEG and is aimed at improperly benefiting the Income Tax Group (ITG). The petition sought that the Sept 12, 2009 memorandum should be declared void.

These officers said they have joined the service on merit after qualifying the Central Superior Services (CSS) examination and argued that only parliament can determine the re-composition of a service and matters ancillary thereto and not the Establishment Division through an order.

The petition said that the order by adversely changing terms and conditions of the service is also a clear violation of Civil Servants Act, 1973. Every CEG officer has been appointed with prior approval of the Establishment by accepting an offer of the FBR to join this group subject to certain terms and conditions, express and implied. A condition of the offer was that change of occupational group would not be allowed in any case, the petition said.

They argued that by giving option to join IRS or a group or service, which will be renamed in future and manage business of one tax or levy, the FBR intends to breach the solemn contract.

They said that under the new memo, there is no clear and final declaration of cadre strength of IRS with detail of posts in each grade due to which they could not make an intelligent and informed decision.

They said that the order appears to be based on fallacious assumptions. It is grounded in abdication of sovereign authority to international monetary institutions, they said.

The Pakistan Customs and Excise Service was initially constituted with effect from Jan 1, 1960 vide S.R.O 597(K) of Dec 18, 1959 by amalgamating the Pakistan Customs Service Class I and the Class I posts in the Central Excise and Land Customs Department into a unified Central Service Class I. This SRO, which was issued by the President of Pakistan, was in field on the commencing day of the 1973 Constitution; and its article 268, read with its article 241, protected all existing laws including this SRO, unless modified by appropriate legislature, these officers said.

'Inland Revenue Service Group' functioning: draft 'ordinance' sent to Cabinet, Law Divisions
RECORDER REPORT
ISLAMABAD (September 26 2009): The Federal Board of Revenue (FBR) has sent the proposed Ordinance on proper functioning and administration of 'Inland Revenue Service Group', covering income tax, sales tax and federal excise officials, to Cabinet Division. Talking to Business Recorder, FBR Chairman Sohail Ahmed said here on Friday that the 'Ordinance' has been dispatched to the Cabinet Division and vetting by the Law and Justice Division for proper legal backing.

Primarily, this 'Ordinance' is related to smooth working of income tax, sales tax and excise officials under the 'Inland Revenue Service'. This would help the tax officials in proper administration and working under the new integrated setup in the field formations. To avoid any kind of difficulties by income tax, sales tax and excise officials, the 'Ordinance' has been drafted to facilitate new integrated structure of the FBR, he said.

He clarified that the proposed 'Ordinance' would be promulgated after completion of all legal processes and formalities as required under the law.

It is worth mentioning that the functional reorganisation of the FBR, including the revision of the structures of Regional Taxpayer Offices (RTOs) and Large Taxpayer Units (LTUs), will be completed by end of September, 2009. The FBR has already issued instructions to the Directors-General of LTUs and RTOs and Chief Collectors of North and South on the creation of new occupational groups ie 'Inland Revenue Service'.

The 'Inland Revenue Service' has been set up covering income tax, sales tax and federal excise officials. This 'group' would be responsible for carrying out the functions relating to income tax, sales tax and federal excise. Each officer of the existing Customs and Excise Group and the Income Tax Group has been called upon to exercise option for inclusion into the new 'Inland Revenue Service'. In case no option is given it would be deemed that the officer desires to remain in his/her original group.

According to FBR instructions, the proposed setup is to be circulated among all officers of customs and excise and income tax groups under administrative control of respective DG/Chief Collector and obtain irrevocable option from each officer of the existing Customs and Excise Group and Income Tax Group for inclusion or otherwise into the new 'Inland Revenue Service'. The option so exercised in each case may be submitted to Member (Admn) FBR by September 28, 2009.

there s still so much confusion in this, 1 can't be fully sure as to what would be ultimte structure and function of FBR's constituent grps.....theres is a heated debate among political circles, in all the 4 provinces, about giving Sales Tax to the provinces. if so, then won't it be provincial excise and taxation deptts to look after da sales Tax? or IRS will become an all Pakistan service like Police and DMG ie working at both provincial and federal levels?....and will Pakistan Customs' Service be more like USA's Customs and Border protection group? if so, then customs will also be a very prestigious service though with a slightly different role. atleast this is wat authorities are seemingly trying to do.

Creation of IRS, changes in tax laws being reviewed: World Bank mission meets FBR officials

ISLAMABAD (September 29 2009): A World Bank (WB) review mission on Monday started meetings with the Federal Board of Revenue (FBR) on creation of new Inland Revenue Services (IRS), 2009-10 audit plan, broad-based implementation of the value-added tax (VAT) and legal changes in tax laws to prevent revenue leakage.

Sources told Business Recorder here on Monday that the schedule of the World Bank mission meeting had been kept confidential due to security reasons and prevailing law and order situation. The mission would convene detailed meetings with the tax managers from Sep 28 to October 16 to review Tax Administration Reform Programme (TARP).

The mission members included lead economist Satu Kahkonen, senior financial sector specialist Anjum Ahmed and consultants Carlos Silvani, Orlando Reos, Paulo dos Santos, Wyatt Grant and Daniel Alvarez. The sources said that the World Bank and the FBR would take policy decisions on the VAT implementation at the retail stage.

Two special meetings would be convened from October 14 to 16 to discuss VAT in view of suggestions of Tax Advisory Council, international VAT conference and policy discussions on VAT taking into account the viewpoint of the stakeholders, particularly business community and provinces. The administration of new VAT law at provincial level would be discussed to bring retail sector into the tax net.

Other key issues included composite audit of corporate sector and update on enforcement plan to check exceptional level of non-compliance. Over 54 percent of the registered corporate sector, 76 percent individuals and 83 percent of the Association of Persons (AOPs) are non-filers of returns for the 2008 tax year.

The mission would convene a meeting with the Director General, Human Resource Management (HRM), to review details of new Inland Revenue Service and options for the tax officials to adopt new service group. A draft of the Presidential Ordinance on IRS has already been dispatched to the Cabinet Division for approval.

Meanwhile, Pakistan Customs and Excise Officers Association have filed writ petitions against the creation of IRS with the Lahore High Court, Rawalpindi bench. The sources said that the World Bank officials would meet the FBR Member, Enforcement and Accounting, to have an update on measures to increase revenue collection and implementation of the enforcement plan in the field formations.

The mission would convene meeting with the FBR Member, Legal, to discuss the legal changes related to the FBR organisational structure, harmonisation of taxes and prevention of revenue leakage and improving tax compliance through strict enforcement.

The World Bank would also convene a meeting with the heads and operational wings of the Large Taxpayer Units (LTUs) and Regional Tax Offices (RTOs) to review integration plan in the field formations. The reporting functions at the LTUs would also be discussed under the integrated policy. The head of the TARP and its Programme Manager would brief the mission on the implementation of reforms under new organisational structure. The FBR communication plan, addressing technical and organisational, issues would also come under discussion.

The FBR Member, Taxpayer's Audit, would give detailed briefing to the mission officials on audit selection criterion, strength of auditors and implementation of the annual audit plan (2009-10). According to sources, the Director General and staff of RTO, Rawalpindi, would review progress on audit and enforcement plans. The review of the process envisioned for the adoption of new occupational groups and career streams would also be discussed.

Pakistan Revenue Automation Limited (PRAL), a subsidiary of the FBR, would brief the World Bank on an action plan and progress in various IT areas like expansion of e-filing, plans and progress on data centre, underlying structures and databases being used for IT systems, ie Mahasil, CREST and 'STMS', identification and replacement of duplicate functions and other aspects of IT action plan. The rollout of CREST, a sales tax verification system, would also be discussed during the meeting.

On October 7, the mission would leave for Karachi to meet officials of RTO, Karachi, under new organisational structure and implementation of audit and enforcement plans. The wrap-up meeting would be convened on October 13 at the Ministry of Finance, which would be attended by Minister of Finance Shaukat Tarin, FBR Chairman Sohail Ahmed to discuss the mission's recommendations on the TARP.
