Please read and understand the following before you take any action:-

According to the rules laid down by the commission and duly approved by you before the tests..

"Answer papers in all the subjects of examination are secret documents and cannot, therefore, be permitted to be seen by the candidates or their representatives nor re-examination of answer books/scripts is allowed under any circumstances. A candidate desirous of getting of his/her marks, awarded by the examiners re-counted may submit his request for the purpose, within one month from the date of issue of result card/marks sheet alongwith a Treasury Challan of Rs. 200/- per paper as fee for re-checking/ recounting of marks only. Thereafter, no such request will be entertained."

"Subject to the Recruitment policy... Candidates securing the highest places on the combined results of the written Examination, Psychological and Viva Voce tests and eligible for appointment will be appointed upto the number of vacancies available. No candidate will, however, be considered for appointment to any of the Groups/Services for which he/she has been declared “not suitable” by the Commission at the time of Viva Voce test."

We have a precedent in which a candidate appealed in Peshawar High Court and Director Examination had to appear before with answer sheets in the court. Now????

Well bro it depends .. Suppose the precedent you have turns out to be a case of HSSC or SSC or of any University degree and not specifically of CSS, then the judge may rule against you on the very first hearing .. Because I have heard about people seeing their answer-sheets (if dissatisfied) after College or University results, but not in CSS ..
And as far as I know the cases regarding CSS are dealt on the policy grounds .. Like in politics they get away by saying 'Qaum k waseeh tar mufaad mein faisla kiya hai' .. You may take policy decisions by the courts in the same sense if talking in layman terms ..

Honestly, I have never heard about CSS answer-sheets being produced in court .. Because, there is a term in law 'flood-gates' .. If there was a precedent like that, then it would have already opened the flood gates for other applicants as well ..

However, If indeed you have a precedent relating CSS, then you must give it a try ..

Allah sab k liye aasaaniyan paida farmaaye ..

Regards ..

In addition to what Stunner has said.. if you think that you can base your case on that precedent and challenge FPSC's marking criteria or the interview's panel decision to fail the candidates (due to whatever reason) then simply go ahead. But keep in mind Bhagwandas' reputation in the echelons of judiciary. Frankly speaking, you won't find any potent loophole to exploit and get the things done in your favour. Its like striking one's head against the wall. Khair.. best luck and regards
