How can i be declared a FAILED CANDIDATE

According to RULES FOR COMPETITIVE EXAMINATION CSS-2013
Page 3 Article 11 (i) The Commission with prior approval of the Government may fix qualifying marks in any or all of the subjects of the examination [B]but a candidate who fails to secure at least 40% marks in any compulsory subject, 33% marks in any of optional subjects, 50% marks in the Aggregate and 100 marks in Viva Voce, will be considered to have failed and will not be eligible for appointment.[/B] |
Rule has changed I suppose. Let me quote:
QUALIFYING MARKS 11. (i) The Commission with prior approval of the Government may fix qualifying marks in any or all of the subjects of the examination but a candidate who fails to secure at least 40% marks in any compulsory subject, 33% marks in any of the optional subjects, 50% marks in the Aggregate and 100 marks at the Viva Voce, will be considered to have failed and will not be eligible for appointment. |

If you check previous rule, then you will notice "Or" which is not present in rule of 2013. It means that if a candidate fails in any optional, then he will be considered as Fail. |

i think you have a case. they probably made a mistake. you should not have been declared failed per my understanding. it says "prior approval" that means that government should have made a formal approval. that should be available in a file and on note sheet.
you should first file an appeal with the fpsc chairman, then you have to go up. that is the legal way to go. dont go directly to a court. ask a lawyer. |
good luck nate . though i dont know you but i wish you the best of luck in this regard . Allah keray keh politely hi kam ho jayee . its true that a simple OR should not change the fate of anyone because we aren't lawyers that read the rules word by word and interpret them . so a benefit of doubt must be given to you in this case atleast for this time (2013). also fpsc would not have a burden by giving you a pardon as at the most 2 or 3 candidates would have such a case .

thnx a lot brother for ur all out support ..yes definitely i ll be contacting fpsc and if need arise i ll be coming to islamabad and will beseech a meeting with the chairman |
