The term precept means a letter of request which is issued by executing court to another court in whose local limits the property of judgement debtor is situated to attach the property of judgement debtor in order to compel the judgement debtor to join execution and execute the decree.
set off means counter claim of the defendant against the plaintiff arising out of a transaction independent of the plaintiff's claim. set off is a plea of defence which can be raised in written statement and by adjustment reduces the plaintiff's claim. it is a counter claim in the nature of a cross action. Inter pleader suit means a suit in which the real dispute is in between the defendants only and the plaintiff is not interested in the subject matter of the suit. but he just seeks decision of the court to the effect that to whom he pays, or deliver the money or property |
