OBJECTIVE SERIES PAKISTAN PENAL CODE
MUHAMMAD IMRAN BAKHT ADVOCATE


1- Life denotes the life of a human being, unless the contrary appears from the context.

2- Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to seven years.

3- Arsh denotes the compensation to be paid to the victim or his heirs.

4- Without exposing the bone of the victim, the accused is said to cause Shajja-e-Khafifah.

5- Qisas for qatl amd shall not be enforced when the offender dies before the enforcement of Qisas.

6- An officer above the rank of constable can perform duties of an S.H.O.

7- Section 54 deals with commutation of sentence of death.

8- Section 55 deals with commutation of sentence of imprisonment for life.

9- Section 55-A deals with saving for president prerogative.

10- Section 57 deals with fraction of terms of punishment.

11- Section 63 deals with amount of fine.

12- Section 64 deals with sentence of imprisonment for non payment of fine.

13- Whoever causes the jurh in which the injury extends to the body cavity is said to have caused... Jaifah.

14- Whoever by force compels, or by any deceitful mean induces a person to go from any place is said to abduct that person.

15- Section 73 deals with solitary confinement.

16- Section 75 deals with enhanced punishment for certain offenders under chapter xii or chapter xvii after previous conviction.

17- Section 77 deals with the act of judge when acting judicially.

18- Section 80 deals with accident in doing a lawful act.

19- Section 82 deals with act of a child under 7 years of age.

20- Section 83 deals with act of a child above 7 and under 12 years of age of immature understanding.

21- Section 84 deals with the act of a person of unsound mind.

22- Section 94 deals with act to which a person is compelled by threats.

23- Section 95 deals with the act causing slight harm.

24- Section 96 deals with things done in private defence.

25- Section 97 deals with right of private defense of body and property.

26- Section 99 deals with the act against which there is no right of private defense.

27- Section 106 deals with right of private defense against deadly assault when there is risk of harm to innocent person.

28- Section 107 deals with abetment of a thing.

29- Section 108 deals with abettor.

30- Section 108-A deals with abetment in Pakistan of offences outside it.

31- Section 109 deals with punishment of abetment if the act abetted committed in consequence and where no express provision is made for its punishment.

32- The liability of abettor when one act abetted and different act done is the same, provided the act done was a probable cause of the abatement.

33- A criminal conspiracy is an agreement between two or more persons to do or cause to be done an illegal act or a legal act by illegal means.

34- Electoral right means the right of person to stand or not to stand as candidate and to vote or not to vote in election.

35- A person is said to commit house breaking by night when he commits house breaking after sunset and before sunrise.

36- Section 110 of Pakistan Penal Code deals with Punishment of abetment if person abetted does an act with different intention from that of Abettor.

37- Section 111 of Pakistan Penal Code deals with the liability of Abettor when one act abetted and a different act done.

38- A criminal conspiracy is an agreement between two or more persons to do or cause to be done an illegal act or a legal act by illegal means.

39- Badiah is not a kind of Shajjah.

40- Kidnapping includes kidnapping from Pakistan and kidnapping from lawful Guardianship.

41- Theft has been defined in section 378 of Pakistan penal code.

42- Giving False evidence is an offence under PPC according to section 191.

43- Stolen Property has been defined in section 410 of Pakistan Penal Code.

44- Thug is one who is habitually associated with any other for the purpose of Robbery or child-stealing by means of or accompanied with Qatl.

45- Cheating has been defined under Section 415 of Pakistan Penal Code.

46- Diyat means the compensation payable to the heirs of the victim as specified in Section 323 of Pakistan Penal code.

47- Daman means the compensation determined by the court to be paid by the offender to the victim for causing hurt not liable to Arsh.

48- Section 468 of Pakistan Penal Code deals with Forgery for the purpose of Cheating.

49- Forgery has been defined under section 463 of Pakistan Penal Code.

50- Isqat-e-Haml is an offence under section 338 of Pakistan Penal Code.

51- Kidnapping is of two types according to section 359 of Pakistan Penal code.

52- Defamation has been defined in Section 499 of Pakistan Penal Code.

53- Jurh has been defined in Section 337-B of Pakistan Penal code.

54- Punishment of Jaiffah is given in Section 337-D of Pakistan Penal Code.

55- Ghayr Jaiffah is a Jurh, which does not amount to Jaiffah.

56- Common Intention is disclosed by the facts in the evidence and circumstances of the case.

57- Public Servants includes any person who holds any office of the Government.

58- Arsh for causing Itlaf of a fingure of a hand or foot is one-fourth of the total Diyat.

59- A person is said to do a thing Fraudulently if he does that thing with intent to defraud but not otherwise.

60- A person abets an offence by abetting the commission of an offence or by abetting an act which would be an offence.

61- According to Pakistan Penal code, "Person" includes any Company or Association or body of Persons.

62- Whoever does anything with the intent of Causing wrongful gain in one person or wrongful Loss to another person is said to do that thing " Dishonestly".

63- Qatl-e-Amd shall not liable to Qisas when the offender caused death of his Grand child, or When any Wali of the deceased is the direct descendent of the offender, or When an offender is a minor or When an offender is Insane.

64- According to Section 378 of Pakistan Penal code, the property in theft has to be moveable property.

65- According to Pakistan Penal Code, "vessel" denotes anything made for the conveyance by water of human beings or of property.

66- Nothing is an offence which is done in the exercise of the private defence according to section 96 of Pakistan Penal code.
Qisas means to copy the other.

67- Under Section 363 of Pakistan Penal Code, Punishment for Kidnapping is Seven years with fine.

68- Right of Private Defence is primarily subject to restrictions contained in Section 99 of Pakistan Penal Code.

69- When all the incriminating facts and circumstances are found to be incompatible with the innocence of the accused, then the Influence of guilt can be justified.

70- House Trespass is dealt under Section 442 of Pakistan penal code.

71- Section 149 of Pakistan Penal Code creates a distinct offence.

1- For Abetment it is not necessary that the Person abetted should be capable of committing an offence under the law or should have the same guilty intention.

2- Right to private defence is available where there is no time to have recourse to the protection of Public Authorities.
Right of private defence extending to causing death is mentioned in Section 103 of Pakistan Penal Code.

3- General exceptions are contained in Chapter IV of Pakistan Penal Code.

4- Ten types of punishments have been prescribed under section 53 of Pakistan Penal Code.

5-Life denotes life of a human being under section 45 of Pakistan Penal Code.

6- For Application of section 149 of pakistan Penal Code, the offence must have been committed in prosecution of the common object and the Offender must be a member of Unlawful Assembly.

7- Wali means a person who is entitled to claim Qisas.

8- The word "injury" denotes any harm whatever caused illegally to a person in body, mind reputation or property.

9- "Special law" is a law applicable to a particular part of Pakistan.

10- Injury has been defined in section 44 of Pakistan penal code.

1- Theft, by clerk or servant, of property in possession of master has been dealt by section 381-A of Pakistan penal code.
2- Criminal breach of Trust is the subject of Section 405 of Pakistan Penal Code.
3- Punishment for Importation of girl from Foreign country for the purpose of prostitution is provided in Section 366-B of Pakistan Penal code.
4- Section 71 of Pakistan Penal Code, deal with the limit of punishment of offence made up of several offences.
5- The payment of Arsh may be paid in Lump sum installments extending over a period of Three years from the date of the decision.
6- Personating a Public servant is an offence under section 170 of Pakistan Penal code.
7- Itlaf-e-udw is defined in Section 333 of the Pakistan Penal Code.
8- According to Section 82 of Pakistan Penal code, infancy is an exception.
9- The Rule of Wholly Incapax is laid down in Section 82 of Pakistan Penal code.
10- Intoxication as defence is contained in section 85 and 86 of Pakistan Penal Code.
11- The value of Diyat is equivalent to 30630 grams of Silver.
12- According to section 306, a minor is not liable to Qisas.
13- The right of Qisas shall not be waived where the Government is Wali.

1- When an act is abetted and a different act is done, The abettor is liable for the act done.

2- "Hadd" means punishment ordained by the Holy Quran and Sunnah.

3- "Tazir" means any punishment other than Hadd.

4- Nothing is said to be done in good faith which is done without due care and attention.

5- "A" voluntarily burns a valuable security belonging to "Z", "A" has committed Mischief.

6- Attempt to commit Suicide is punishable with imprisonment of one year or with fine or with both.

7- Unlawful Assembly comprises of at least Five persons.

8- "Section" denotes one of those portions of a chapter of this code which are distinguished by prefixed numeral figures.

9- Dishonest misappropriation of property has been defined under section 403 of Pakistan Penal Code.

10- Rape is an offence against human body.

11- Section 97 of Pakistan Penal code extends the right of private defence of property to the offence of Theft and Robbery.

12- If an offender has been sentenced to imprisonment not exceeding Six months, the Solitary Confinement shall not exceed One month.

13- Section 95 of Pakistan penal code deals with the principle of " de minimus non curat lex".

14- The value of Daman may be determined by the court keeping in view the expenses incurred on the treatment of the victim, the loss or disability caused in functioning of any organ of the body, and the compensation for the anguish suffered by the victim.

1- The Arsh for causing Itlaf of a tooth shall be one-twentieth of the Diyat.

2- Section 66 of Pakistan penal code deals with the description of the imprisonment for non-payment of fine.

3- Unnatural offence can be committed with man, woman, and animal.

4- Oath means a solemn affirmation or any declaration required or authorized by law to be made before a public servant, or to be used for the purpose of proof.

5- The punishment of taking gratification for exercise of personal influence with public servant is imprisonment of simple nature extend-able to One year with or without fine.

6- Rape has been defined in section 375 of Pakistan Penal Code.

7- Wrongful confinement for Ten or more days is the subject matter of section 344 of Pakistan Penal code.

8- Abetment by Instigation may be by spoken words, by conduct or by letters.

9- Extortion has been defined in section 383 of Pakistan Penal code.

10- Hijacking has been defined in Section 402-A of Pakistan Penal Code.

11- A Robbery becomes a Dacoity if there are five or more than five persons.

12- Intention and Dishonesty are the elements which constitute theft under section 378 of Pakistan Penal code.

13- Punishment for theft is imprisonment for 3 years and fine.

14- Whoever being a public servant or banker or merchant commits breach of trust, shall be punished with imprisonment which may extend to Ten years and fine.

15- Mischief is defined under section 425 of Pakistan Penal code.

16- Punishment for Mischief is imprisonment up to 4 months or fine or both.

17- Attempt to commit Suicide is an offence under section 325 of Pakistan Penal code.

18- Wrongful gain is gain by unlawful means of property to which the person gaining is not entitled legally.

19- Movable property includes corporeal property of any description except land and anything attached to the earth, or permanently fastened to anything which is attached to the earth.

1- A person is said to lose wrongfully when such person is kept wrongfully out of any property, or when such person is wrongfully deprived of property.

2- Public includes any class of the public or any community.

3- Servants of the state are all the officers or servants continued, appointed or employed in Pakistan, by or under the authority of the Federal government or by any Provincial Government.

4- Arsh for causing Itlaf of an organ which is found singly in the human body shall be equal to One-half of the amount of Diyat.

5- The legal heirs shall be the wali in case of Qatl and if there is no Legal Heir then the wali shall be the Government.

6- Imprisonment for life means imprisonment for 25 years.

7- Death means the death of a human being according to Pakistan penal code.

8- Right of private defence of the body includes the defence of one's own body and also the body of any other person.

9- The term for which the court directs the offender to be imprisoned in default of payment of fine shall not exceed One-third of the imprisonment maximum fixed according to Pakistan penal code.

10- Whoever cheat by personation shall be punished with imprisonment for a term which may extend to 14 years.

11- Sections 63 to 70 authorize the award of imprisonment in default of payment of fine .

12- Whoever intending to take dishonestly any moveable property out of the possession of any persons without that person's consent , if moved that property it will amount to theft according to Pakistan Penal code.

13- Adultery is an offence against husband as defined in section 497 of Pakistan Penal code.

14- Chapter XX of Pakistan Penal code deals with offences related to Marriage.

15- Immovable property can be the subject matter of Extortion.

16- Furnishing of false information to the court is an offence under section 177 of Pakistan Penal code.

17- Public Servant can be called as a witness through process of court.

18- If an additional fingure of the victim is cut then there is no Qisas.

19- Section 68 of Pakistan penal code deal with the termination of Imprisonment on Payment of fine.

20- Section 69 deals with the termination of imprisonment on payment of proportional part of fine.

21- Rash driving in a manner as to endanger human life is punishable with imprisonment of either description for a term which may extend to 2 years or with fine or with both.

22- Adult means a person who has attained the age of 18 years.

23- House trespass is the subject of section 442 PPC.

24- Lurking House trespass is the subject of section 443 of PPC.

25- House-Breaking is the subject matter of section 445 of Pakistan Penal code.

26- Criminal trespass is defined in section 441 of PPC.

27- Qatl shibh-e-Amd shall be liable to diyat and may also be punished with imprisonment of either description for a term which may extend to 14 years as Tazir.

28- Whoever is guilty of the offence of procreation of minor girl, shall be punished with imprisonment upto Ten years and fine.

29- Punishment for Qatl-e-Amd is provided in section 302 PPC.

30- House breaking by night is the subject matter of section 446 of Pakistan Penal code.

31- Foreigners are not exempted from criminal prosecution in Pakistan.

32- The limit of Solitary Confinement is defined in section 74 of Pakistan penal code.

33- In Dacoity the involvement of five or more person is essential.

34- Conspiracy to wage war against Pakistan is the subject matter of section 121-A of Pakistan Penal code.

35- Mere words does not amount to Assault.

36- Section 420 deals with cheating and dishonest inducing delivery of property.

37- Cheating is punished with imprisonment upto one year or with fine or with both.

38- Cheating has been defined under section 415 0f PPC.

39- Shajjah is of 6 kinds.

40- A "will" is a testamentary document.

41- Punishment for receiving stolen property has been defined under section 411 of Pakistan Penal code.

42- Criminal intimidation has been defined in section 500 to 506 fully.

43- The accused appears on left side of the judge in criminal cases.

44- A person is said to counterfeit who causes one thing to resemble another thing, intending by mean of that resemblance to practice deception, or knowing it to be likely that deception may be practised.
