IN BPS – 17 UNDER THE FEDERAL GOVERNMENT, 2012.

MERCANTILE LAW


TIME ALLOWED PART-I MCQs 30 MINUTES MAX MARKS: 20
THREE HOURS (PART-II) 2 HOURS & 30 MINUTES MAX MARKS 80
NOTE: (i) Candidate must write Q.No. In the Answer Book in accordance with Q.No. In the Q. Paper.
(ii) Attempt ONLY FOUR questions from PART-II. All questions carry EQUAL marks.
(iii) Extra attempt of any question or any par of the attempted question will not be considered.

PART –II

Q.2 section 10 of the contract Act says that ‘all agreements are contracts if they are made by the free consent of the parties competent to contract, for a lawful consideration and with a lawful object, and or not expressly declared to be void,. Explain fully what is intended by wording, not expressly declared to be void’. Be brief ad the point.

Q.3. Discuss the circumstances under which a contract is discharged.

Q.4. What rights are conferred on an unpaid seller? Explain an unpaid seller’s lien. Under what circumstances an unpaid seller loses his lien?

Q.5. Explain ‘Sale by Auction’. When does title of goods passes from the seller to a buyer in an auction sale?

Q.6. How would a court determine the existence of a partnership? Explain the principle laid down in Cox v. Hickman.

Q.7. Discuss the significance of ‘Resolutions’ in regulating the affairs of a company. Explain what is meant by the doctrine of ultra vires a company?

Q.8. Who may be appointed as an arbitrator? Describe the powers of an arbitrator under the Arbitration Act, 1940.

you should have opted this subject as you did MBA. i also opt this subject, because i also did MBA. i opted BA as well, but it cost me expensive.

Business Administration includes Management, marketing,HRM, FM. 4 books 4 just 100 marks, so plz recommend Business administration should b opt? i think no,
need recommendations:confused:

Please recommend me more subjects as i m so confused. i did B.SC with maths, statistics & economics before my MBA. :blink

Firstly, Business Administration includes: FM, Marketing, and Management. i opted this subject in my first attempt i.e 2012 and found it too lengthy to cover up, hence i have replaced it with language now. i also did MBA(B&F).
i would suggest you some optional:
Journalism 100 Marks (easy to prepare)
Sociology 100 Marks (Easy to Prepare)
Mercantile Law 100 Marks ( Unequivocally, it would be easy for you as you have studied it in MBA like me)
any Language 100 Marks. ( i opted Pashto)
Indo-pak history/ islamic history/ British history/ European history (i found British history more easy to prepare) 200 Marks.
These are my optional as well. now you should go through previous papers of these subjects and make your mind. Regards.

it would be my 1st attempt
pure mathematics would be tough to cover, as it demands practice, it would be difficult to cover wide syllabus,
i m doing job as well. it is difficult for me to cover maths.
do you suggest me to opt maths?
what would u suggest for economics(200), maths?
on the other hand ,i can opt statistics 100 marks if i m unable to cover maths,
there is any substitute for language subject?
i m unable to join academy bcoz of my job, i need more guidance from your side :thinking

Well sid i have studied Statistics and Economics in my bachelors and Master's, but i didn't opt it because of many reason:
1.these are not scoring subject esp: Economics.
2. you should opt those subjects which help you out in other subjects too.
3. mathematics and statistics has nothing to do with any other subject.
I have been told by CSP that always chose those subject which is scoring as well as co-related with other subjects.

furthermore, you can replace language with mercantile law, US History, or IR( IR is low scoring but help you out in other subjects).

to remaining mercantile law, sociology, journalism, history of india & Pakistan, baki 100 reh gya 1 subject ka,

aur books ka b ni pta :con:roll

jo CSS forum pe syllabus k sath recommend ki gai hn lazmi wohi books?
