Default Constitutional Law 2010

Here goes the paper:

2. "Despite parliamentary form of governments in India and Pakistan, the presidents of both the countries stand poles apart from each other." Discuss.

3. "Articles 62 and 63 of the Constitution of Islamic Republic of Pakistan 1973 just adorn the legislation, but infact are far from being actually practiced." Do you agree?

4. "Paradoxically, the special position of Islam in the constitution of Pakistan has proved less problematic." Discuss.

5. "The right not to be deprived of one's life or liberty without the authority of law was not the creation of the constitution. Such right existed before the Constitution came into force." Discuss in the light of the statement, the protection afforded to personal freedom under the Constitutions of India and Pakistan.

6. "The power and jurisdiction of parliament, says, "Sir Edward Coke, is so transcendent and absolute, that it can not be confined, either for causes or persons, within any bounds." Discuss.

7. "In many continental countries, and notably in France, there exists a scheme of administrative law known to Frenchmen as driot administratif - which rests on ideas foreign to the fundamental assumption of our English Common law and specially to what we have termed the rule of law."

8. Discuss the election, powers and removal of the president of USA.

In the Indian president versus Pakistani president, I started from 1947 and wrote about the constitutional problems faced by Pakistan then wrote about the 58(2b) and then abput Musharraf's 17th Amendment.

@Above

6. "The power and jurisdiction of parliament, says, "Sir Edward Coke, is so transcendent and absolute, that it can not be confined, either for causes or persons, within any bounds." Discuss.

This question is about UK constitution...

My strategy to this question was different as the question was actually about comparison and contrast of the both the Presidents. I highlighted the executive, legislative, emergency, judicial and financial powers of both and explained the nature, scope and their practical implementation.

It was a little unexpected but not difficult paper at all for any serious candidate. The Indian and French constitutions must be studied comprehensively by the candidates to tackle such surprises.

As per my knowledge and sources, 18 mcqs are correct in my attempt.

I wish all the CL fellas good luck.

cheers,
floydian

I wrote it the same way,in introduction I wrote that both countries had the Westminister system of Govt in which the PM had the real power as he was the representative of the people and that the president was nothing more than a titular head of state just like the British queen, after that I explained the powers of both of them in detail except that in case of Pakistani President I stressed on the powers that were granted to him by the 17th Amendment etc..
