Bro in my opinion the candidates were meant to take into the consideration the general consesus because its not specified that by consensus examiner meant only Ijma and one more thing I think candidates were to attempt this question only if they disagreed as specified in the question.

what an easy paper really. , Thnx God!!! i am over with my papers.

As for as the power of parliament to do Ijma is concerned, you are very right; the current Parliament of Pakistan can't do Ijma because of so many reasons. But according to Allama Iqbal, the power should be given to an assembly that follows a specific pattern.

Exactly.... As mentioned in his book Recreation of Muslim Thought in Islam but even in that case, are members of parliament qualified as jurists/Mujtahids?

guys, i think the parliment can also be taken as ijma, there are many reasons,
first lets consider the types of ijma. there are three types
1) consensus of the companions
2) consensus of the jurist
3) consensus of the general public
parliment falls in the third kind
there are also provisions in the constitution which prevent from any law which is unislamic from coming into effect
then there is the islamic ideology counsil to see that all the laws are according to islam
then there is a shariat court
then the parliment or legislative whicle making islaming laws can get the help of jurist.
furthermore in this day of age no one other then the parliment can be there which represent the majority of the people. the essence of ijma is the majority of the people agree. Parliment fullfills this criteria

Yeah you are right, but kindly put light on the qualification of the person who can participate in an Ijma proceedings. I mean they are quite similar to that of a Mujtahid.

I have read that Ijma is of five (5) kinds.

1. Regular Ijma
2. Irregular Ijma
3. Ijma-ul-Ummah
4. Ijma-ul-Ulama
5. Ijma-i-Madina

In which category will our parliament fall? Not in First two and the fourth because only JURISTS with specific qualification can participate in these three.

If talking about Ijma in Parliament under strict Islamic rules, than it is also clearly mentioned that only A MUSLIM JURIST may participate in Ijma proceedings. So in parliament you'll have to keep out the non-Muslim members. Even if it is a matter of whatever field, like you yourself said, we have to ponder upon it keeping in mind the Islamic ideology.

I have not attempted this question, but my thoughts are as above.

I will be happy to have a reply and be corrected where wrong.
