Muslim Law and Jurisprudence Paper 2003
Attempt Five Questions in all ,including question No.8 which is compulsory.All questions carry Equal marks. Write clearly.
Q1-Explain the kinds of prohibition to Muslim marriage and its effect on the legitimacy of children? Q2- What is the maintenance and what are the legal effects of non-maintenance of wife? What is the time limit for maintenance of a divorced wife? Q3- Define 'Mushaa' and state the rules as regards its gift under Sunni and Shia Laws. Q4- Discuss the nature and extent of a muslim widow's right to retain possession of her husband's estate in lieu of her dower. Q5- Many muslims believe that 'Ijtehad' is absolutely necessary in modern times to keep pace with the changing world.Comment. Q6- Discuss the development of Islamic Law during the Umayyad caliphate. Q7- Discuss the concept of an Islamic State. What are your views on interest-free system in a country like Pakistan? . . |

COMPULSORY QUESTIONS
8. (A) Write only Yes/No in Answer Book. Don’t reproduce the question. 1. The interest of wife in deferred dower is a contingent one. 2. Wife is entitled to lodging in the husband’s house during iddat. 3. A widow is not entitled to maintainence during iddat. 4. A hiba-bil-iwaz is not revocable. 5. A contingent gift is valid in Muhammadan Law. 6. Malik Ibn Anas was actually a traditionalist. 7. Areeat is the grant of license to take and enjoy the usufruct of a thing. 8. Istihsan literally means a collection of rules or principles by the method of analogy. 9. Development of Muslim Law falls into three historic period. 10.
