Save the Judiciary to save Pakistan
 

After even 60 years of creation, we are failed to establish a Stable Political System for our Country. Extra Constitutional Steps were taken at the very initial Stages by the then Political Cum bearurcrate Leader Ship. After Inclusion of Ayub khan in the Federal cabinet of Sikandar Mirza, as in Service Defense minister, Army involved in the Government affairs.. Ayub Khan imposed the First marshal law in 1958.After this The Generals of Pak Army remained the Major Players in the Political System Of Pakistan. Most of the Time Ruled Directly, and the Remaining Period, they ruled indirectly.

In their all the extra constitutional adventures, our Judiciary provided the Legitimate ground to the adventurers, on the Basis of Doctrine of Necessity that was invention of Justice Munir in his Decision to affirm the Dissolution of assembly by the Ghulam Muhammad.

It is said that if our Judiciary hadn’t supported the Dictators, our History might be different. But the Juggles who end The Judiciary dosent possess the requsite power to repeal the unconstitutional act of Dictator.If they declare this unconstitutional and
order the Dictator to quit ,the Dictator will abolish the entire Judicial System Cosequently the public will lose even a weak Judiciary and dere will be Absolute rule of army.

However First Time in Pakistan, Some Juges of Supreme court strived to Get Rid from The Doctrine of Necessity. However the Dictator Couldn’t tolerate them.

Wat are its Inplication?In future No Judge will do this.And we will be moving in a Circle.A Political government will Come and after some years another General will Take over.And we will remain in this Circle.

This is very strategic point in our History.We should make verry effort to save our Judiciary. Because its Gordian of our rights.Its only Defense against the the Political Ambitions of the Generals. Otherwise Democracy in Pakistan will become a dream.

I think all the Democratic Forces must Unite over this point of Restoration of Judiciary..If Judiciary is restored, it will ensure a Stable and Democratic Pakistan having Respectable place in the World Community.Oderwise ………..

yes, i agree that judiciary should be saved.This is need of the hour.
Before nov 3,supreme court had gained power.And people started considering it a ray of hope against injustices.But military rulers could not bear it.It,s so sad how chief justice iftikhar Muhammad chaudhry and other judges of supreme court were removed.
And after that,lawyers, journalists and civil society was beaten mercilessly but there was not anyone from judiciary to take any action against it.
And the decisions by present supreme court under pco are ridiculous.
They rejected the petitions against president musharraf eligilbility in few hours and now in another decision they have given verdict in favour of emergency and pco .And this is the time when because of emergency common wealth has suspended pakistan .An international organization didnot care of the lame excuses given by government but present supreme court
is giving decisions in its favour...

First of all round of applause for you to raise such an important issue. I was thinking to start a poll at related topics. I do believe that our young generation dont have political insight as they should have because our education system donot support political vision.

Here addition of another fact that just after the inception of Pakistan Daultana and Mumdoot having disagreements on power basis introduced the concept of Army rule in 1951 but it was governend by the Punjab Governor and lasted only for few months. Then offcourse Ayub was the person made political system physically disable in the country.

Saleeqa I believe one thing that although Justice Munir was responsible but dont you think that generation of that time was more responsible who havent raised voice against it and accepted the death of constitution by the sole biased person.

For the first time judiciary stand against the dictator even treated badly just like terrorists. But the problem not ending here because general public is not supporting them as they should be supported. [B][COLOR="blue"]Justice Wajeeh-ul-Deen The Great Man whose devotion, allegiance and commitment to the constitution is above board[/COLOR][/B] maltreated by police when he went to visit CJ Iftikhar Chaudary yesterday look at his dignity that rather speaking harshly and saying something bad to them today he went to them with flowers and set an example for upcoming generations to follow.

When talking about future implications we have to look the present realities. No doubt you are very right that its an ongoing circle that will never end till we are bound under [B][COLOR="Red"]"Doctrine of Necessity"[/COLOR][/B]. We have to get rid of it at all costs.

[B][COLOR="SlateGray"]SC larger Bench headed by the Chief Justice Mr. Justice Abdul Hameed Dogar in its short order issued here today said that the situation in the country was horrific—suicide bombings were taking place and the security forces were being targeted especially, the in the tribal areas, where the situation was highly critical besides over 150 persons were killed in an attack on the People’s Party rally, while the executive was left paralyzed by the conduct of some of the members of the superior court.

In such circumstances, SC short order said that the extra-constitutional measures had become imperative and, therefore, the SC deemed valid Army Chief’s all those measures taken after November 3 besides validating the process of taking oath under PCO, while the order also said that the Judges not taking oath under PCO ceased to remain on their posts.

The order further said that the constitution be restored with the improvement in situation and the Court would have the right to review the situation any time. [/COLOR][/B]

Yes its critical point where I think there should be "Shame on the Judges who acclaimed Emergency Valid just to save themselves and their person benifits"
They have put real death to the solidarity of nation and Judiciary. Now there is no question left for democracy because Musharaf is successful in poisioning democracy for its final death.

And we will be standing silently to see that how are rights are being grabed by military ruler.

We will be waiting for the desertation of Balochistan and then Sindh and then some other area and then we will say that a political government was responsible for losing East Pakistan while in real sense it was Ayub Khan who laid base brick for it.

Lets do pray that we may get leaders like Sir Syed Ahmed Khan, Moulana Abu-ul-Kalam Azad, Moulana Zaffar Ali Khan and so on....... who can evoke the soul of this sleeping nation to stand for their basic rights.

No doubt fouzia that after 9th March the scene was changed and Judiciary came to strong footings on 12 July when CJ Iftikhar Chaudary reinstated his place by the [B]Ever Shining Decision of CJ Bughwan Das[/B]. This event paved way for new developments towards democracy. But like ever before dictators can never tolerate to lose power and see some other pillar at apex.

Its the misery of our nation that only few are condemning Judicial hijack by President Musharaf. Uplift of Emergency is promised but no one has assured restoration of Judiciary because its visible threat to the power of President Musharaf.

Internationally they need Musharaf as their strong ally because only Musharaf is the person who can put death to his people on the name of [B][COLOR="Red"]"War against Terror"[/COLOR][/B]

It’s really unfortunate to have such a sociopolitical chaos in Pakistan. The military dictator trying his best to impose his self wishes under the good name of policies over the hearts and minds of 169 million people. The hidden motto of the military dictator is "[B]Goli,Danda or Ghulam[/B]" seems going successfully. But it’s a proven fact that bullets can't stop mind storms and ideological slavery can't provide you the solution to the road of success.

I totally agree with u on above points,,,,,, u explain in exellent manner, but one thing i want to discuss here,,,,,,,

Fouzia said that judiciary gained power after 9 March,,,,,,, today date is 25 Novembers,,,, total days of Judiciary struggle is 8 months and 16 days,,,,,,,, just think that is it possible for an institution which remain under pressure for 40 or 50 years and can easily get its lost glory or power,,,,,,,, i think no it is not possible,,,,,,,,, we should work and judiciary also work on sound basis because just think that it is not possible to change the sensitive things immidiatley,,,,, we can say that this is an initiative and infact a good initiative taken by over judges after 9 March but now they are facing difficutlies,,,, (Agg hee lohay koo mazboot Kundan banati hai), so we should not disappointed on this moment,,,,,,,,,, if we examine the history than we find many many examples who work from very little step but with courage and determination they achieve the desired result. Main example is our Creation of Paksitan,,,,,, it was the struggle of near about 90 years from 1857 to 1947,,,, there were so many difficulties and obstacles faced by Muslims but they achieved the desired result with determination,,,,,,,,,,,, And i think the one and only Example is the Preaching of Islam by Hazrat Muhammad(PBUH). He (PBUH) faced many difficulties but at last succeeded in His (PBUH) task( Preaching of Islam).

And u know very well when we want to change any existance thing than we must sacrifice something on it,,,,,,,, or when we are fighting for right cause than we must sacrifice somethings with open heart we have the example of "Karbla Incident",,,,,,,,,

so the main thing is, that we should focus on our goals and never loose our heart with small difficulties,,,,, and it is not easy to change the things within some time it take time,,,, it is long time process, which require our determination, sacrifices and honesty towards achieving goals......
