Post Disqualification of Nawaz Sharif and Shahbaz Sharif.

Asslamulaikum,

Let's have the views and opinions of Aspirants how do they see the decision of " DISQUALIFICATION OF NAWAZ AND SHAHBAZ"..
As expected from the followers of Brave General!!!
Here is the detail.....
The three-member Bench of Supreme Court has disposed off Sharif brothers’ electoral eligibility case by declaring them ineligible for contesting elections in its two-line short order announced here.

Shahbaz Sharif under this verdict has lost his seat in the provincial assembly and being no longer member of the Punjab House, he is no more Punjab chief minister, as SC has annulled the earlier notification about his being chief minister.

This case was under hearing of the SC three-member Bench headed by Justice Musa K. Laghari for the last eight months, in which, the Attorney General of Pakistan, Latif Khosa giving his arguments said that Punjab chief secretary and speaker were not the party in the case. Attorney General said that all the judges have taken oaths under the constitution and talking about the oath of the interim constitution was irrelevant.

He said that Nawaz Sharif’s proposer and seconder could become parties in the case if the court permits them and their becoming parties was not necessary. He further said that it was the discretion of the judge to withdraw from the Bench and no one could direct him to pull out.

On conclusion of the arguments, after a short break, the Bench disposing off the Sharif brothers’ eligibility case declared them ineligible.

Following the verdict, Sharif brothers’ lawyer, Akram Sheikh told media that the decision was as expected, as the government was giving dictation to the judges. He said that Sharif brothers were declared ineligible on the orders of President Zardari. He said that the judges would be made accountable on the Day of Judgement. Akram Shiekh said that now it was up to the people to decide if the verdict was on merit. He said that he couldn’t comment on the incomplete two-line judgment. This decision would be presented as bouquet to President Asif Zardari on his return from the China tour.

ML-N workers in sizable number were present on the occasion of the announcement of verdict raising slogans in favour of long march and Sharif brothers. Security arrangement remain tightened in the capital city here.

Pakistan's Supreme Court nullified on Wednesday the election last year of Punjab province's chief minister, a lawyer said, effectively dismissing Shahbaz Sharif and raising fears of renewed political instability.

The court also declined to rule on a challenge to an electoral ban on Punjab chief minister Shahbaz Sharif's brother, former prime minister Nawaz Sharif, effectively maintaining a bar on him standing for election.

The court's decisions to nullify the election of Shahbaz Sharif raises the prospect of confrontation between the country's two main political parties.

Pakistani stocks fell 4.2 per cent as investors sold on fears that the country was heading into a fresh phase of political instability.

'Shahbaz Sharif's membership (of the provincial assembly) has been cancelled,' Akram Sheikh, a lawyer supporting the Sharif brothers, told reporters outside the Supreme Court.

Neither of the Sharif brothers were in court.

Asked whether Shahbaz Sharif would remain chief minister of Punjab, Pakistan's biggest and politically most important province, Sheikh said: 'It's the natural consequence of this, how could he remain chief minister?'

Shahbaz Sharif vacated the CM House after the court's decision.

Both Sharif brothers were barred for legal reasons from standing in an election last year in which their party came second.

A court later acquitted Shahbaz Sharif over accusations of involvement in the extra-judicial killing of five militants in 1998, when he was the chief minister of Punjab, Pakistan's richest province and home to half its 160 million people.

That cleared the way for him to contest a by-election, which he won. He then became chief minister of Punjab.

Nawaz Sharif was ousted as prime minister in a 1999 coup by former army chief and president Pervez Musharraf.

He was barred from running in the general election in February last year because he had been convicted for the 1999 hijacking of then army chief Musharraf's aircraft, an action that triggered the military coup that overthrew him.

The Election Commission later ruled he could contest a by-election for a seat in the National Assembly. But in June last year, a court disqualified Nawaz Sharif from contesting the by-election.

The Supreme Court had been hearing challenges to that ruling.

The Sharifs head the Pakistan Muslim League (Nawaz) party, which came second in a general election in February last year.

The party later dropped out of a coalition with the party of former prime minister Benazir Bhutto, which won the most seats in the election, over a dispute over the restoration of judges Musharraf had earlier dismissed.

The brothers appear unlikely to ask the Supreme Court to review its decision. They have refused to appear before it in person and cast doubt on its legitimacy to hear the case.

Nawaz Sharif has already announced his support for a massive rally next month by lawyers whose protests over the past two years helped drive former President Pervez Musharraf from power.

A big slap to democaracy!

I think the decision is partial and rightly according to the wishes of Mr. Zardari. After BB's assasination last year PML-N appeared to be a party with a clear point of view. And they also open-mindedly accepted the results of the ELECTIONS-2008. They are behaving since then as mature politicians. And Mr. Shahbaz has gained a very good popularity amoung common people due to his good policies and justified activities. But due this disqualification is a big slap to democracy. This will surely lead to a long lasting political instability in the country. Some scene of this instability in the country can also be seen on TV today. May Allah guide us to right way! May Allah keep our country in His kind protection!

Cool decision

what can be said against supreme court decision as we all know these politicians have very old habit of playing blame game against each other , when decision goes against them they call it injustice and biased judgment and when in their favour they welcome that decision with open arms , well these politicians are always at war against each others and they are all after getting fame and popularity thats it ,and blaming courts in it , is a slap on judiciary and nation.

Well I think that the Invisible Government hates peace in the country, therefore whenever there is any chance of peace and prosperity some violence is started.

Technically and legally it is correct and expected decision. Sharifs conviction is still valid.

Politically it is a wrong decision. This will add fuel to long-march fire. It would have been a wise decision if PPP govt. kept this pending till long-march.

As far as disqualification’s practical implication is concerned, in future if people vote for Sharif, such legal disqualification is no hurdle in holding public office. After all its Pakistani politics.

I don't have words to say!
It is really a huge shock to political stability. Even our political situation was not smooth but it was going towards real essence of democracy, but the current verdict of Supreme Court of Pakistan would lead this on a contrary path. God knows better about the verdict that is it taken timely and is that impartial or dictated by current goverment. As far as the concern of demolishing the proviancial goverment, in my humble opinion atleast this was not the right time to take such type of action against a goverment who was doing great as compare to other provincial goverments.

May ALLAH save our country from such type of confiscation.

@ Ineligibility Decision

I am in no position to comment on the legal intricacies of the verdict of Supremecourt but following the political developments and being a political activist and keen observer of the political processes right from the college timings and being a member of an infuential political family having strong political ground and knowledge i will just say that its a big slap on the democracy and the mandate of the people.

I am not fan of Nawaz Sharif neither i nor my family have supported them in Past but as a matter of fact their ineligibility case was based upon biasedness and the double game by the ruling party can be seen and realized by a layman who has some sort of common sense. I saw these glaring shortcomings in the whole procedure of court during this case.

intensions of judges can be seen in their remarks during the hearings.
judges being human are subject to error and they can become biased if the accused dont recognise them as legal.
they judges withdraw themselves from the bench if accused have reservations over them which in this case was not followed.
The Defense council was till yesterday arguing for the larger bench and accrding to them they haven't yet started the arguement on the merit of the case and the bench gave its verdict. How rediculous.
I think its the first case where the attorney general from the federation side gave arguements against the fedaration's cause that was stated at the time when the federation appealed that the federation is going to defend the Sharif Brothers.
And Above All the steps and actions show the intentions of the people. The governor Rule in Punjab, reshuffling of bureaucracy and other such measures taken by the federal government and presidency show the real intensions behind the decision.

May Allah Guide us and give us wisdom to learn from previous mistakes but its also a fact that men has learn one thing from history that men don't learn from history.

I take it as a murder of democracy. This question comes into my mind that was the NRO only for PPP?

People make law for themselves and the juidiciary implement those lawas. But if people elect a person as their representative then whyjuidiciary doesnt accept them as a will of people.

If zardari, rehman malik, salman taseer, salman farooqi, ishrat ul ibad can be the part of administration then why cant be Shrif Brothers?

Preople had already knew regarding the crimes of Sharif brothers but inspite o it they elected Shehbaz so it means people want them as thier represent.

SC should respect the mandate. Hamid Doggar took revenge of his daughter Faraha Hamid.
Zardari and his cabinet is not consists of devine angles. If they have right to participate in politics despite their crimes then Sharif brothers also have.

This will bring terrible consequences in future and this decision is more dangerous for PPP than MNL.

Zardari is ruining the reputition of PPP.

This verdict has pushed the country towards more instablity.

This act of PCO's judges will cause the PPP's fall in next general elections.

When we see the Bilawal Bhutto' quote "Democracy is the best revnge"
which Zardari also quotes in his speeches and interview then no one has right to disqualify the elected represent of people.

Everyone knows the hands who are behind this verdict.

Just look the past statement by the Salman Taseer you will come to know that Zardari has been planing this since when.........

73 Consrtitution has been ruined and need to restore it. If Zaradi is an honest man then why he restore the 73 Constitution although he has power to do that.

Cool Court contempt

Sharif's were continually contempting the Prestigious Supreme Court of Pakistan. Though he is a famous politician but it is responsibility of every Pakistani to respect our courts. It doesn't matter whether there are PCO judges or not.Justice Iftikhar is also a PCO judge many times. Supreme Court had already indicated during case proceedings that Sharif's can't expect relief till they appear personally before court. Lawyer of Sharif's was continuously adopting very aggressive cum rude behaviour that Sharif's Don't accept verdict of PCO Judges. If they Don't accept PCO judges what were their Lawyers doing in Supreme Court. So all public should accept it open heartly. It is system of nature.
