Question article 8 and 11

first of all these are not articles but sections ok.

section 8 is about the civil cases arising in FATA. all these civil cases will be refferd to the counsil of elders commonly know as jirga in FATA. the jirga or council of elders will inquire and come to the findings on the matter and will give it to the APA. then PA or APA or TEHSILDAR will decide the matter in dispute on its findings.

Section 11 is about criminal refrences of the cases. study both sections now and u will understand.

man you've done a great job,giving details about FCR.i would like to add up afewthings to the history of FCR and to the brief about FATA.
FATA is a political construct defined by its unique structure of governance and its demography.it is a direct legacy of the british raj which regarded this part of the frontier with afghanistan as a buffer zone and imposed political control over it without provision of public services or integration with rest of the india.
FCR which comprises a set of rules was specifically devised to counter the fierce opposition of the pakhtuns to the british rule, and its main objective was to protect the interest of the british.it dates back to the occupation of the six pakhtun inhabited frontier districts by the british in 1848the regulation was reenacted in 1873 and again in 1876 with minor modifications.subsequently,allowing for more changes,FCR was promulgatwd in 1901 as you said.
i believe this detail'll add to getting more about fata.
anyway man how r u?are you going to take on ce 2010?

well u are wrong.

Section: when a law is passsed by the parliament and become an ACT it is in the form of sections or divided into parts, parts into chapters and then chapters into sections. sections are further divided into clause and then sub-clause. all administa=rative substantive and procedural law are in the form of sections.

Article: Articles are in those laws made by an authority other than parliament. these laws cannot be changed but through amendment or proclamation. eg PCO, LFO, Martial law orders etc.
examples of such laws which are divided into articles are Costitution of a state, Qanoon-e-shahadat order etc.

Exclamation Admn. Officers of FATA

ROLE AND RESPONSIBILITIES OF ADMINISTRATIVE OFFICERS IN FATA:

PA is the top Administrative officer in FATA.
After PA is APA, and
After APA is TEHSILDAR

Tehsildar is the most important officer in FATA as all the cases(criminal aw well as social) some directly to him. After inquiry he decide the case abd send report to APA or PA. Orijinal jurisdiction lie with Tehsildars.

Tehsildar perform the following four type of functions:

1. Criminal
2.Civil
3.Developmental activities
4.Miscellenious issues or routine minor issues.

TRAITS OF POLITICAL TEHSILDAR:

A Tehsildar must have the following qualities while serving in FATA. Because there are some expectations from Tehsildar.

1. Good reputation......he must not be a persona non grata.
2. Dependable and not dependent.
3. Well informed.
4. Proactive.
5. Propose timely and productive actions.
6. Takes 'QAUM' i-e Tribe into confidence.
7. His draft to the APA or PA should be concise and worthy.
