New Nikah Nama law introduced in Punjab
 
[B]Please guys , have your say regarding amendments in Nikahnama law.What do you think how much it can benefit the new couple and their families.[/B]



The Punjab Government has made eight amendments to the Nikahnama Law which include mandatory medical checkup of both bride and the groom, parents/guardians of both bride and bridegroom to sign the nikahnama document as witnesses. Mention of the bride and bridegroom’s date-of-birth has also been declared binding.

Before the 18th Amendment was passed, the nikahnama and divorce forms were federal subjects. Now they have come under the jurisdiction of the provincial governments.

A circular was issued by the Local Government and Community Development Department and sent to all DCOs in Punjab, describing the Punjab specific amendments.

[U][B]The amended law makes it necessary for both the bride and bridegroom to undergo a blood test, to prevent disabled and handicapped births.[/B]

The amendements include:

[B]1. Additional columns and space to provide for dowry articles in the nikahnama

2. In addition to naming the fathers of both the bride and bridegroom, the names of mothers of both the bride and bridegroom shall be recorded with their CNIC numbers and dates of births.

Father and mother of the bride and bridegroom shall sign in the witness to the marriage column.

4. Marks of identification of both the bride and bridegroom shall be incorporated in the nikahnama.

5. Medical check up and report of the bride and bridegroom shall be mandatory to obviate any problem in their matrimonial life and subsequently any chance of having abnormal children. Blood groups of the bride and the bridegroom shall be entered in the marriage certificate.

6. The name of the bride usually changes after the marriage is solemnized which then appears in future documents of the new family. Such a projected change shall be recorded in the certificate.

7. Instead of mentioning only the age of the bride and bridegroom, their exact dates of birth shall be recorded as in their school certificates/CNIC/Passports.

8. The latest passport size photos of the bride and bridegroom shall be pasted on the certificate.

The amendments are effective as of Thursday July 8 and no nikah document will be registered without fulfilling these requirements, the circular says.

Keeping in view the needs of modren times and prevention of unhealthy births, it was a good move by the Punjab Gov., but sadly the notification has been cancelled as per latest report on media. :0

Pak Punjab Govt' withdraws new clauses from 'nikahnama' following massive criticism

Following massive criticism, the Pakistan Punjab province's government has withdrawn the new clauses that it had implemented in the 'nikah' form.

Confirming the withdrawal of the clauses, provincial Law Minister Rana Sanalullah said the government has decided to withdraw the notification regarding the new sections in the 'nikahnama' for the time being, The Daily Times reports.

The new clauses had evoked severe discontent among people, who were of the view that new sections would increase forced marriages.

Former Information Minister Sherry Rehman voiced her reservation over the introduction of new clauses, terming the step against women's freedom.

"The originators of such designs are the people who do not wish women to have their due status in the society," Rehman said.

"The country at present is facing a number of challenges and some forces want to further aggravate the situation by instigating new issues," the Pakistan People's Party (PPP) leader said.

Noted social worker Farzana Bari had also criticised the move.

"It seems as if the Punjab government is not aware of the ground realities of the high illiteracy rate, which prevails in the society," Bari said while referring to the clauses such as the signatures of the parents on the nikah form and writing of the groom's date of birth.

Bari, however, backed clauses such as mandatory blood tests of the bride and groom, saying "it will help in uncovering diseases like AIDS"

"The clause to attach pictures on the nikah form would be beneficial in discouraging bogus marriage certificates," she said. (ANI)

I think some of it's clauses which were in the interest of the couples must be incorporated,like:

7. Instead of mentioning only the age of the bride and bridegroom, their exact dates of birth shall be recorded as in their school certificates/CNIC/Passports.[/B](It will save from early marriages)

pasted on the certificate.[/B](If this is must for CNIC and other documents then why not for Nikah Nama)

Vested interest never allow to happen anything useful in our society, that is why we are unable to become a welfare state.
All the amedments were good from medical and statistical data point of view but the blackmailer dont allow to implement it on the name of religion.

[B]I don't think the first to conditions were useful.Rather those can create trouble for the bride and groom.And how come the following clause be useful?

[B]This clause must be incorporated and implemented across the country without wasting a minute.This clause can save our upcoming generation from HIV,Aids,thalassemia and so many other fatal diseases.

As for condition No. 1, u know sometimes it happens that marriage does not go as expected and matter reaches to the point of divorce through court. At this point both the parties demand the return of the dowry and other gifts and enter bogus claims about these things in court and it becomes difficult for the court to decide. The list of dowry works at this point.
As for condition No. 2, there is no harm if the fathers/mothers become witness of the marriage as they are more close then other relatives.

Yes ,there's no harm and usually fathers also become witness,but it must not be obligatory otherwise it will cause only problems.

All the amendments were good, but i am very sure that IF they are implemented the Qazi, and Molvi's would have placed a BIG cross on all these points, as unfortunately it happens in most of the families that NikahNama is not given to the bride to read it fully, she only has to sign, alsoi have noticed that even now their is a big cross on 3/4 points of it, regarding divorce rights
so first of all maulana sahab should be educated enough TO CONSIDER the amendments, only then its useful
