Judidical Activism and the Establishment of Constitutional Courts in Pakistan
 

Today's newspapers carried Senator Farahatullah Babar's comments regarding the establishment of Constitutional Courts in the country as outlined by the Charter of Demcracy (CoD). The document was signed between Nawaz Sharif and Benazir Bhutto during the reign of General Pervez Musharraf and many of its elements have already been brought into practice by the previous PPP administration.

Will the establishment of these courts act as an effective deterrent to curb judicial activism in the country? What are some suggestions which may potentially improve the efficacy of this institution, for example, the process of appointment.
