Default Induction on deputation ‘contemptuous’: SC

KARACHI, March 16: The Supreme Court on Friday expressed grave displeasure over the induction of officers in different provincial departments on deputation in violation of an apex court order terming the induction contemptuous and derogatory.
“If such actions of the Government of Sindh are allowed to be perpetuated it would destroy the institutions and paralyse the system,” observed a two-member SC bench comprising Justices Sarmad Jalal Osmany and Amir Hani Muslim, who directed the court’s office to place the matter before the Chief Justice of Pakistan for further orders.
While hearing a suo motu petition against the builder mafia in Sukkur on Wednesday, the bench had taken notice of officers inducted on deputation and directed the advocate general to submit a detailed comprehensive report in this regard.
On Friday, AG Abdul Fateh Malik placed a report showing that 109 officers were inducted or posted on deputation in the Sindh government in defiance of the apex court’s judgment.
He also placed on record the copy of a notification issued by the chief secretary on March 15 regarding the repatriation of 81 officers to their parent departments.
However, the court observed that there were many officers who were not mentioned in the report.
The bench noted that earlier the secretary service had furnished a list of inducted officers in the Sindh High Court in a petition. “Out of the said list many officers were not relieved/repatriated by the Government of Sindh in defiance of the directives of the High Court and this Court, inter alia, on the ground that some of them were absorbed under Sindh Civil Servants (Regulation of Absorption) Act, 2011. In all there were ten police officers who are claimed to have been absorbed in the Sindh Government after the judgment,” the bench observed.
The bench further observed: “In the intervening period, instead of complying with the aforementioned judgment of this court, the Government of Sindh has further inducted/deputed officers from other departments/organisations, which act ex-facie is contemptuous and derogatory”.
The bench said that the provincial government inducted officers on deputation and in some cases absorbed them permanently “in order to frustrate the judgment of this court”.
The court observed: “Under these circumstances, we feel that actions on part of the Sindh Government warrant interference by initiating contempt proceedings against those who are guilty of willful defiance of the directions of this court as mentioned hereinabove”.
The bench ordered its office to place its orders on the matter before the Chief Justice of Pakistan in a separate file for passing appropriate orders and adjourned the matter to the next session.
