Your law officer may be right but as per my common sense, one would contest a case only if he is sure about the outcome.

Yes you are right every case has to be contested first.Here in this special case this person is uncertain about outcome of his case which might be in process so its most probable that he would like his attorney to dismiss it.Atleast to me it seems so.
