Seniority Policy in Federal Government
 

I have a query hopefully gets the answers from here, I wanna ask what is the Seniority Policy in Federal Government (Through FPSC), If any one have genuine answer with some reference please post it against my question.

Seniority in Civil Services is accounted cadre/service wise and its policy is governed under Section 8 of Civil Servants Act, 1973; and Civil Servants Seniority Rules 1993 which were formulated in light of Section 8 of Civil Servants Act 1973.

If 2 persons were recommended by the FPSC on 2 posts i.e one sindh and one punjab, and one of them refuse to join it, whereas other person joined the services, after 8-9 months fpsc gives the chance to the 3rd runner-up for the same, my question's starts from here, what would be the seniority of both in such case ??

The Seniority is usually counted from the date a person joins the Govt. service. If the seniority (to recommend for promotion) in a department is quota-based than you have no comparison of a Sindh domiciled person with a person holding Punjab's domicile.

In Federal Secretariat, for example, the initial appointment is based on quota but the departmental promotion is based on seniority inter alia. So the person holding a post for the most span of time wins the promotion.

Regret courageneverdies, i didnt get what you were trying to explain.

Nevertheless, as far as this question is concerned, the seniority of both of them will be reckoned from the merit list of FPSC not from date of their joining. If the third person's seniority is determined by FPSC above then the second person thn irrespective of the fact that he joined after 8 or 9 months after, his/her seniority will be above thn the person at No.2.

Conversely, if FPSC has issued merit list and person at Number 3 is placed after person at No.2, thn his/her seniority will be fixed after person at No.3.

Seniority is not decided as per quota of individual rather as per merit list of FPSC.

Remember, FPSC always issue revise merit list once all the persons/officers join service under that recruitment process.

Section 2 sub-section 2 of Civil Servants Seniority Rules 1993 is relevant in this case, which is reproduced as under:

2. Seniority on initial appointment.–

(2) If two or more persons are recommended in open advertisement by
the selection authority their inter se seniority shall be determined in order of
merit assigned by the selection authority.

FPSC advertise 3 post 2 from Punjab and one from Sindh, one of the 2 from Punjab gives the joining, along with person from sindh, but one of them refuse to join.

After sometime ( 8 months) FPSC gives the chance to next available candidate and he joins on the behalf of Punjab quota.

But after one years FPSC sends the seniority in which person from sindh fall from 2nd position to 3rd ?

Question is why and is this possible and what should that person do against that?

Seniority of Civil Servants is maintained accoring to the merit of FPSC and not according to their joining date.

An answer suiting you may not be the right/correct reply. Dear I am a civil servant and dealt with the seniority cases, I will reiterate that the seniority of an individual is reckoned as per the merit list of FPSC and not from date of joining/quota etc. Relevant rule has already been quoted. The person from Punjab may have high merit as compared to person from Sindh, as such his seniority will be over and above thn the person from Sindh irrespective of their joining dates.

For example, there were two final persons one from Punjab and other from Sindh, the person from Punjab was having 55 marks in merit, while the person from Sindh was having 52 marks. If person from Punjab is not going to join the organization, next eligible candidate from Punjab will be called for the post, and he may be having 53, or 54 marks and in that case his merit was above to the person from Sindh. After his joining, his seniority will be above to the person from Sindh. Its fairplay.

That person should not feel disgruntled or dismayed, the seniority is adjusted as per the Civil Servants Seniority Rules, 1993 and no representation lies to it. However, if he/she still feels troubled, he/she may give representation, but will get the same reply.

Seniority of officers/officials qualified through FPSC is maintained according to the merit list issued by FPSC, however, seniority for appointments made by offices otherthan FPSC is maintanied by date of joining and, if same date for more than one employees, then by date of birth.
