I have gone through the point of view of all buddies. Guys, let me share with you one thing. I have been working under Federal Govt in BPS-17 for the last 5 years. During this period, I have come upto very short conclusion that no rule is prevalent in Pakistan in its true essence. Every body is busy to interpret the rules in his own terms. Every effort is exerted to get the interpretation of rule to seek own benefit only. I simply know that in Pakistan one rule is applicable i.e “Show me the person, I will show u the rule” (Yani Mje Banda Dikhao, main khud dekhu ga konsa rule apply karna ais per”

Ok that was my personal opinion based on five years experience. Now come to exact point regarding acceptance of resignation.

It is true and clearly mentioned in Civil Servant rules that employee has to continue the service until resignation is accepted. It is also clarified for you people that Competent Authority for acceptance of resignation from BPS-17-19 is concerned Secretary so defense secretary is empowered to accept the case of resignation of officer in question. Secondly, one of my friends is saying that immediate boss can’t return the case back to employee. Oh my dear, if he has done so, it is understand that he has done it on behest of Higher Authority and his remarks can’t be challenged anywhere. Purpose is only to convey to message to officer that Department can’t relieve you due to shortage of manpower no matter whoever conveys the message.

At the end, I would brotherly suggest you to try to solve this matter amicably. Confrontational attitude will add further difficulties. TC/MC kar ka apna kaam niklwayo bus, this is the simplest way bro.,..May allah help you.

If the immediate boss is not willing to forward the same to the Competent Authority, an Advance copy of the same may be sent to the Competent Authority. It will not warrant any disciplinary action, and there are chances that the Competent Authority may direct to put up the case on the PUC

if resignation is not accepted by the competent authority with any remarks whatsoever, a government servant can challenge the same letter containing the remarks in the service tribunal after preferring departmental appeal to the appellate authority. this is the only solution otherwise a government servant would liable to disciplinary proceedings for absence from duty, which also includes dismissal and as a result of dismissal, a government servant's career would be destroyed and he would be unable to join any government department. It is adviced to act wisely.

Can anyone please help me. i am being recently selected as LDC in housing and works department. i was working as a LDC in Pak Navy (To be noted it was my probation period, i was not permanent employee) but because of the shortage of time i didn't followed the process of resignation. and joined my new department. now some memorandum and discipline letters are being issued to me from my previous department, mentioning about discipline action "Dismiss/Removal from Service". kindly guide me what should i do? Thank u
