SUBJECT: LAW (PAPER-I)

TIME ALLOWED: THREE HOURS
MAXIMUM MARKS: 100

Note: Attempt in all SEVEN questions; TWO from Part-I,ONE each from parts II and III and THREE from Part-IV including Question NO.9 which is compulsory.

PART-I
(The Civil Procedure Code 1908)
Q.1. Please state five conditions which must be fulfilled for the applicability of provisions relating to stay of a suit under section 10 CPC.

Q.2. What is the Procedure for ratable distribution of the assets of a judgement-debtor , amongst the holders of decrees for money against the same judgement debtor who is not possessed of property sufficient to fully satisfy all such decrees?

Q.3. What are the consequences of non-appearance of the plaintiff or defendant when the case is called for hearing and what remedies are available to a party against whom an order is passed?

Q.4. What is the procedure for filing a suit in forma pauperis?

PART-II
(The Limitation Act 1908)

Q.5. “ Limitation extinguishes remedy, not rights”. Please comment.

Q.6. please describe the nature of suit which may not be barred by nay length of time.

PART-III
(The Registration Act 1908)
Q.7. Please describe the documents of which registration is not compulsory.

Q.8. Please describe the effects of registration and non-registration of documents.

PART-IV
(The Qanun-e-Shahadat Order 1984)
Q.9. Explain:
a). Conclusive proof
b). Examination –in chief
C). Opinion of expert
d). Oral evidence
Q.10. Please state at least five principal classes of fact which have been declared to be relevant by the Qanun-e-Shahadat Order.

Q.11. What are the rules with regard to the reception of evidence of character of a witness or a party?

Q.12. please mention all cases in which secondary evidence of the existence , condition or contents of a document may be given.

Q.13. Write short Note on the necessity and utility of rules of judicial evidence.

Note: Attempt FIVE questions in all in English language. Select TWO questions each from section-A and section-B and ONE from section-C. Each question carries 20 marks.

SECTION-A
Q.1. a). Define the distinguish between preparation to commit an offence and an attempt to commit an offence.
b). What is the difference between common intention and common object as given in Pakistan Penal Code?

Q.2. Define and distinguish among theft, Extortion, Robbery and dacoity and under what circumstances Theft and Extortion become Robbery ?

Q.3. Define and explain Qisas, Badal-e-Sulah, Diyat, Arsh and Daman alongwith Section 302 PPC with full detail and the sentence provided in the murder cases. Please illustrate in what circumstances each sentence can be awarded ?

Q.4. When right of Private defense of a person and property commences and till what time it continues? Please discuss in detail?

SECTION-B
Q.5. Please explain the provisions of law under which criminal courts(Courts of Magistrate and Court of sessions) can put to an end its proceedings even without concluding trial and can acquit the accused?

Q.6. What is Charge? Please state essentials of a charge. Can three offences of same kind within one year may be charged together and what persons may be charged jointly?

Q.7. How bail may be allowed to an accused person who is charged with non-bailable offences. Please explain the relevant law with context to bail before arrest and bail after arrest.

Q.8. Please explain in detail the provisions of law when an appeal against acquittal and an appeal against conviction may be failed. Under what provision of law no appeal lies in certain cases? Also explain the powers of Revisional Court.

SECTION-C
Q.9. Please explain the law in detail regarding partition of the land, restriction and limitation on partition and the procedure provided on admission of application. Is there any law regarding disposal of questions as to title in the property to be divided ?

Q.10. Please discuss in detail the exclusion of Jurisdiction of Civil Courts in revenue Courts.
