Ijtehad is used to address the issues arise in modern era and one can not any clear commandments regarding these issues in primary sources of Shariah.

Islam has defined clear rules for the obligation of jihad. so there is no need of ijtehad regarding this issue.

On the other hand, Ijtehad is not the source of law with out Ijma(consensus of contemporary Ullemas).
