I dont think dr tanvir will lose his seniority by 4 common and join a lower group in merit i.e. PAAS. If he does so, he will be like many others, extremely frustrated with th result of CE 2011 where he unfortunately could not improve. And as far as th petition is concerned, there is no use of challenging viva which is absolutely an oral assessment involving no black and white evidence.. Anyways, again i would say it's all dr's sweet will to opt for whatever he deems fit..
