The question was asking about the first ever constitution, not accord. The first written constitution was Misaq-i-Madina (Charter of Madina) And by the virtue of fact the Charter of Madina was signed in the very year of the migration while, on the other hand, Sulh-i-Hudaybia was held in 6 Hijrah.
