SUBJECT:- COMPETITIVE EXAMINATION FOR THE POST OF PROVINCIAL MANAGEMENT SERVICE (BPS-17)-2008

Law - I

Part – A (Civil Procedure Code)

1. What is an Ex-parte decree and what are the remedies available to a person against whom an Ex-parte decree has been passed?

2. What are the essentials of a plaint? Is there any difference between rejection of the plaint and dismissal of plaint?

Part – B (Contract Act, 1872)

3. An agreement enforceable by law is a contract. In the light of the above statement discuss the essentials of a valid contract.

4. What is meant by “Novation”? What is the effect of Novation?

5. What is the difference between “Contract of Indemnity” and “Contract of Guarantee”? Under what circumstances a surety is discharged in a contract of Guarantee?

Part – C (Law of Torts)

6. Define Torts. How does tort differ from a crime?

7. What is defamation? Explain the main defenses are available to defendant in a suit for defamation.
