Default First instance: Govt sacks female civil servant after 14 years

For the first time in the country’s history, the federal government has terminated a civil servant who failed to clear the Final Passing Out Examination (FPOE).
The decision was taken in compliance with an apex court decree passed on April 14.
Deputy Attorney General for Pakistan (DAG) Sohail Mahmood last Monday submitted a compliance report in the Supreme Court, stating that the Federal Board of Revenue (FBR) had terminated Husna Jamil, Assistant Collector (Probationer) of Pakistan Customs Service (BS-17) due to her failure to pass the FPOE.
The notification of the termination of Jamil – who remained in service for 14 years – was also presented before the top court, wherein it is stated that secretary Revenue Division/competent authority examined the record of the case and observed that Husna Jamil failed to pass the FPOE in the extra chance.
“Therefore, the competent authority has been pleased to discharge services of Ms Husna Jamil (BS-17) Assistant Collector (Probationer) of Pakistan Customs Service (BS-17) under section 6(2) (a) of the Civil Servants Act, 1973 read with rule 6 (c) of the Occupational Groups and Services (Probation, Termination and Seniority) Rule 1990,” the notification read.
Jamil, who belonged to Hangu district, had passed the CSS exam in 1999 and taken up the job in 2000 but she could not pass the FPOE despite three attempts.
When the department issued a show cause notice to her, she approached the Federal Service Tribunal, wherein she got an extra chance but again she failed to pass the FPOE in 2009.
Later, when the FPSC issued show cause notice to her, she moved Peshawar High Court (PHC) to get remedy in this matter.
