Appeal to Chief Justice of Pakistan


THIS is with reference to my CSS 2008 case, civil appeal No.1418/2009, FPSC versus Azizullah Chandio, in the apex court.
I want to draw the attention of the Chief Justice of Pakistan to the victimisation by the FPSC. My candidature was rejected because I was overage by one day, according to the rules of the FPSC. Later on, the rule was amended after the decision of the Sindh High Court regarding my case.

Following the amended rule, the FPSC authority declared the result of a candidate having Roll No.1036 of CSS 2009. Although his case was similar to mine, his result was not withheld.

The cut-off date for deter mining the eligibility of a candidate in terms of age, qualification, domicile, etc., was Jan 1, 2008, but there was a candidate in CSS 2008 , the daughter of an army officer from Punjab, having Roll No. 2635 of CSS 2008. Her date of declaration of graduation result is four days later than the closing date, i.e. Jan 1, 2008, but despite that her candidature was not rejected and she was entertained and allocated, which clearly shows the discrimination and double standards of the FPSC.

Moreover, it is pertinent to mention here that there was a candidate in CSS 1989 whose upper age limit up to six months and one day was relaxed by the then prime minister of Pakistan in letter No. 1/11/87-TV (pt.11) through the Cabinet Secretariat Establishment Division (Training wing), Islamabad dated June 25, 1989.

The eligibility to the extent of age mentioned in public notice dated Sept 30, 2007 is contrary to rule 4 (i) of rules for CSS 2008. However, it has been accepted by the FPSC as rule 4 (i) of rules for CSS 2010 has been amended to harmonise it with the public notice, and there appears no valid reason for impugning the judgment of the High Court of Sindh.

The Supreme Court, while passing an order dated Feb 23, 2010, completely ignored the principle of accrual of le gitimate expectancy to the respondent which heavily found favour with the High Court of Sindh, Karachi, as the scrutiny process must be completed before taking examination.

I belong to an extremely poor family and it was extremely hard for me to pay the review fees and engage the advocate of the Supreme Court. Therefore, it is earnestly requested that the Honourable Chief Justice please take immediate notice of the maladministration and double standards of the FPSC in the above-mentioned cases. Please provide me justice as soon as possible.
