Default Should our judiciary take part in politics of Pakistan?

judiciary is a branch of govt.the primary function of judiciary is to adjudicate legal disputes.judiciary is also responsible for interpreting the law. but according to some the primary responsibilty of interpreting the law not belong to judiciary but belong to legislature(parliament).

what u people think should our judiciary take part in politics of pakistan?

Legislature's job is not to interpret the law but to form laws precisely. Interpretation is the task of the judiciary. And the judiciary has to take part in politics if somebody files a case against a political person or institution. On the flip side, a suo moto action may also be taken by the judge.

All the statuary institutions of the state must restrict themselves to their legal and constitutional jurisdiction .Exceeding the limits always cause instability. Previously, Judiciary abetted the Dictators in their Political ambitions by providing them a legal cover and this practice continued, with few exceptions, until incumbent Chief Justice taken over the charge. After legalizing certain dictatorial acts initially, he decided to stand before the might of the ruler. He was evicted from the office but a mass movement brought him back.

It seems that after reinstatement higher judiciary is making effort to change its previous image before public. Judicial activism is in full swing and public is applauding them for this role. Higher judiciary have given some verdicts of political interest but it is silent when it comes to implementation of legislation regarding certain basic issues of public interest such as abolition of feudalism and land reforms , Labour Rights ,basic education and child labour. Its recent actions have posed the impression of judicial executive conflict and it is being named as one of the active player in power corridors. This notion is destabilizing the democratic process.

Judiciary does not require publicity to gain public confidence. Its decisions build the image. It should adhere to its constitutional authority and let the democracy to prevail.
