PML-N issues charge sheet against Musharraf
LAHORE: The Pakistan Muslim League Nawaz has issued a chargesheet against former president Gen (retd) Pervez Musharraf, demanding that the ex-dictator should be brought back by Interpol, ARY NEWS reports. The charge sheet contains 16 allegations against Musharraf and seven demands from the federal government to take action against the former military ruler. According to ARY NEWS, the 10-page document states that the former president started the ‘adventure’ of Kargil war with India, and used the Pakistan Army for his ‘own personal gains’. In the PML-N charge sheet, Musharraf was also blamed for imposing martial law in the country, using National Accountability Bureau for victimizing his political opponents, killing the veteran Baloch politician Nawab Akbar Bughti and illegally arresting hundreds of people from Balochistan. The charge sheet further states that the former military ruler attacked the judiciary in his tenure by imposing emergency and violating the Constitution. It charges Musharraf for handing over innocent Pakistani people, including Dr Aafia Siddiqui, to the US ‘in return of dollars’, demanding that a commission must be constituted to a probe into the issue. Musharraf was also held responsible for committing massacre in Lal Masjid ordering military operation against its occupants that left hundreds of innocent students dead and unleashed militancy and a chain of suicide bombing in the country. It alleged that he was also involved in a stock exchange scam. In the charge sheet, it was demanded of the government to approach Interpol to bring him back to the country and register a case against him under Article 6 of the Constitution. Talking to a private news TV, Senator Pervez Rasheed of PML-N said after the charge sheet it was now responsibility of the federal government to take action against Musharraf for violating constitution and toppling the government of PML-N To a question that why PML-N is not filing FIA against the dictator, he said “we have issued a charge sheet from the people of Pakistan to the President, Prime Minister and Parliament of the nation, and don’t want to take any step that invite another Musharraf.” The former dictator is currently in London. After the launch of his new political party, All Pakistan Muslim League (APML), Musharraf continues to attract global headlines. In my opinion this issuance of charge sheet is totally pointless and serves no purpose other than to pressurise government. Because otherwise out of 16 offences that the PML(N) has highlighted, they could move the courts and register FIRs for at least the majority on their own, leaving aside Article 6. But they are not serious about that. This is merely a rhetorical reply to Pervez Musharraf and a pressure tactic as these days PML(N) has been gearing up to shift loyalties.

Charge Sheet against the former military dictator General (R) Pervaiz Musharraf
Pakistan Muslim League-N Central Media cell 1. Preamble General Musharraf illegally took over Pakistan on October 12, 1999. After illegally taking over Pakistan, he committed enormous serious crimes against the constitution, the state and the people of Pakistan. His rule brought innumerable miseries to the people of Pakistan. He has been the most corrupted, callous, immoral and ruthless ruler of the country and people were subservient to his whims and wishes. It is high time, he be tried otherwise Pakistan would never be able to get rid of imprudent, self-righteous Napoleonic idiocy of military regimes. 2. Key objective Bring a national culprit into the court of law and try him under article 6 of the constitution of Pakistan. 3. Goals PMLN aims to stop forever, the violations of the constitution of Pakistan and ensure that no one even think to impose martial law ever in the country. 4. Misdeeds of General ® Pervaiz Musharraf Musharraf Following are the misdeeds committed by the former military dictator General Pervaiz Musharraf: 3.1 Imposition of martial law Gen. Pervez Musharraf imposed [illegal Army] Martial Law in the country twice, subverted the Constitution and violated the oath taken by him as Army chief. He kept the elected Prime Minister [Muhammad Nawaz Sharif] behind bars in the Attock Fort, [illegally] detained judges of the superior courts [Supreme Court and High Courts] with their family members and imposed [military] dictatorship at gunpoint. This way, he acted against the Constitution of Pakistan in 1999, overthrew an elected government and dissolved assemblies thus being liable to be tried for high treason under Article 6 of the Constitution. Musharraf violated the Constitution again on 3rd November, 2007 when he imposed emergency, which has been termed as mini-Martial Law and destroyed judiciary in the country. He is on record to have said that he acted extra-constitutionally on 3rd November, 2007. 3.2 Kargil Misadventure He planned and undertook the Kargil misadventure, concealing it from the elected government, sacrificing some 800 [Pakistan Army] officers and men of the Army in the process. 3.3 Misuse of army for his own cause He used Pakistan Army as his personal force, tried to corrupt it and gave promotion to his blue-eyed officers. He used the Army for different unconstitutional and illegal actions meant to prolong his rule, badly affecting the credibility of the national institution. 3.4 Declaration of war against the people of Pakistan He pushed the Army into an undeclared war against its own people without seeking approval from the Prime Minister, Cabinet and Parliament, which has so far resulted in the killing of over 1,000 Army men. Suicide bombings in reaction have also claimed lives of a large number of Pakistanis. 3.5 Blackmailing through NAB He blackmailed and subjected different people to torture and abuse, using the National Accountability Bureau [NAB] to form a [PML-Q] political party. This was he hereby, indulged the Pakistan Army in the illegal act of getting involved in the politics which is again an unpardonable crime. 3.6 Murder of Akbar Bugti He got Nawab Akbar Bugti killed in cold blood to implement the threat he had earlier hurled on him and congratulated the people involved in the killing after the act. 3.7 Disappearance of people and conspiracies in Baluchistan Thousands of Baloch political workers were made victims of enforced disappearance, with their family members still unaware of their whereabouts. Various Baloch leaders, including Akhtar Mengal, were implicated in false cases and jailed. 3.8 Killings in Lal-masjid The Lal Masjid [Red Mosque of Islamabad] was attacked on the pressure of external powers [the Israeli-Zionist Bush-Cheney Junta of War Criminals], resulting in the death of hundreds of innocent boys and girls. 3.9 Abduction of people He abducted , handed over and sold Pakistani Citizen. The numbers are in thousands. Nobody till today, knows where these people are. For this crime only he should be hanged several times. Over 650 of the [Pakistani and Afghan] people illegally picked up from different parts of the country were handed over to the United States in return for dollars. This he [Traitor Musharraf] admitted in his book. 3.10 Cronyism, nepotism, corruption and favoritism He set new examples of cronyism, nepotism, corruption and favoritism. During his eight years in power, Gen. Musharraf made billions of rupees as his close associates got massive contracts from NHA, OGDC, PIA, besides earning billions of rupees in defense deals. 3.11 Attacks on judiciary He illegally deposed the Chief Justice of Pakistan, Mr. Justice Iftikhar Muhammad Choudhry on 9th March 2007, subjected him to torture and unlawfully confined him and his family including small children disallowing anyone to see him or his children going to schools. The Supreme Court on 20th July 2007 in a landmark decision overthrew his illegal orders and reinstated the Chief Justice. He attacked the judiciary again on 3rd November, 2007, enforced emergency, a Martial Law in real terms, acted against the Constitution and deposed 60 superior court judges in one go imprisoning most of them. 3.12 May 12, and October 18, 2007 massacre and other bloodshed Circumstances hint that General Musharraf had played inevitable role in the ruthless killings of 48 precious lives and burning of lawyers on Karachi on May 12 while the deposed Chief Justice of Pakistan Iftekhar Muhammad Chaudhry was supposed to address the lawyers community in the same city. Similarly, more than 150 human lives were demolished on the day when the PPP leader Benazir Bhutto returned in the country after her exile of 9 years on October 18, 2007. He never bothered to hold any inquiry to probe into the happenings and bring about the truth. The people of Pakistan want to know as to who was behind these incidents. 3.13 Promulgation of NRO On October 05, 2007, General Musharraf issued the worst ever law in the history of civilized world. NRO is in direct conflict with the spirit of constitution. NRO was for the protection of corruption which nullified such cases which only the courts were competent to decide. 3.14 Unconstitutional and illegal candidature and election as the President of Pakistan First he over the country illegally by ousting the elected government and perpetuated his rule through an unconstitutional referendum and a so-called vote of confidence from the Electoral College. Later on, he being an army chief contested the presidential election in 2007 which was again violation of the Constitution of Pakistan as well as his oath an army chief. All his acts as well as his election to presidency in 2007 were in clear violation of the Constitution. This again made him an offender under the article 6 and 43 of the constitution and a violator of his oath as the army chief under 244 of the constitution. Pakistan Muslim League-N (PMLN) has always opposed the idea of giving a safe exit to Musharraf and it does believe that it is still the best and a fit case for trial under Article 6 of the Constitution. Reconciliation policy of the government extended to General Musharraf was meaningless as it was nothing but a folly to encourage such national criminals to keep on playing with the fortunes of the poor people of Pakistan. 5. What PMLN Demands through this charge-sheet? 1. Contact him through the interpole and bring him back to Pakistan making sure his production before the court of law to try him for the misdeeds as elucidated above. 2. Invocation and Execution of article 6 of the constitution of Pakistan for the purpose to penalize him against his crimes against the constitution of Pakistan, the state of Pakistan and the people of Pakistan. 3. Formation of a commission on the Kargil so that those responsible for the misadventure could be brought to book. 4. Constitution of an independent commission for purpose to probe into the situation which had lead death of more than 48 people. 5. Penalization of General Musharraf for violation the human rights in lieu of NRO, abductions, massacre, disappeared people and putting curbs on the media. 6. Transformation of his resignation into dismissal and revoke his entire fringe benefits, facilitations and immunities which he is currently enjoying as a retired government official (army chief). 7. Hold an independent commission to inquire into the matter which he admitted in his book named “In the Line of Fire” with special reference to his revelations that he had been receiving a handful amount mounting to billions of US dollars for the war against terror and handing over the people to the United States which are known as missing persons. 6. Annexure Article 6 of the constitution of Pakistan- High treason (1) Any person who abrogates or attempts or conspires to abrogate, subverts or attempts or conspires to subvert the Constitution by use of force or show of force or by other unconstitutional means shall be guilty of high treason. (2) Any person aiding or abetting the acts mentioned in clause (1) shall likewise be guilty of high treason. (3) Majlis-e-Shoora (Parliament) shall by law provide for the punishment of persons found guilty of high treason. Oath of the army chief under 244 (In the name of Allah, the most Beneficent, the most Merciful.) I, ____________, do solemnly swear that I will bear true faith and allegiance to Pakistan and uphold the Constitution of the Islamic Republic of Pakistan which embodies the will of the people, that I will not engage myself in any political activities whatsoever and that I will honestly and faithfully serve Pakistan in the Pakistan Army (or Navy or Air Force) as required by and under the law. May Allah Almighty help and guide me (Ameen). On October 12, 1999, General Musharraf violated the oath prescribed for the members of the armed forces under Article 244 of the Constitution. Conditions of President's office, Article 43. (1) The President shall not hold any office of profit in the service of Pakistan or occupy any other position carrying the right to remuneration for the rendering of services. At the time when he contested the election for the office of the president of Pakistan, he was still Chief of Army Staff.

i agree with maliasghar .. PML n is just trying to put some pressure and nothing else and to take some advantage on the name of musharaf. Even if they get Govt. in center. they cannot bring mushraf to court.
Woh kehty hai kuch is tarha k " hamam mei sub nangy hai " .. Not even PML n PPP PML q MMA or any other party can hold mushraf trial. |

Well said 6561 They are just trying to cash favor on his name,if they really want,then they could have positively tried but its just to get sympathies of our poor nation for next elections. Werna Dr.Afia ko wapis laana b bara masla nae tha,but no one tried sincerely,so Musharraf ko laana is beyond there....

In this case what will be the future for Musharraf? As he prmoised he will be back after announencment of next election's date.What do you think he is honest in his decison of coming back to Pakistan or this is just all to get asylum.
As there is demand by PML (N) to bring him back through interpol. If he get asylum what do you think what would be the next step? |

1. PML(N) would continue to harper on the rhetoric of trying Musharraf for treason etc. You must understand that weaker political entities need a publicly hated enemy to not only keep themselves united but also attract public towards them. This has also been the case at the State level, where successive governments tried to bedevil India and 'foriegn hand' to justify their actions. In my opinion PML (N) is weak, as frankly speaking, their two stints in power were not remarkably outstanding. At very best they were just mediocre periods. Plus, even now they do not have any strong vision, or a plan to take out the country from the current mess. If they had one, it would have been manifested in some form in Punjab where they have an almost unchallenged government.
Plus PML(N) also knows that it will never be easy to try Musharraf for any of his alleged crimes. It will be far more difficult to prove any against him. There will be innumerable difficulties, obstacles and many people/institutions will stand in the way as every one has some where been a part of dirty politics. 2. Musharraf will not come back, nor will he have any need to seek asylum. He will continue to live abroad on the pretext that he has danger in Pakistan, because, supposedly 'he speaks the truth': the truth that West wants to hear and which antagonises Pakistanis at all levels. West will therefore continue to provide safe accommodation to him. Of and on, he will issue statements which will evoke responses from people and parties here in Pakistan. So this type of statements and counter-statements suit both Musharraf and those here. It is just the people who are being made fool by diverting their attention from core issues.

Infact whatever PML(N) or PPP says, they do not have even so much courage to take a resolution against him in Assembly.
Each of them is suggesting the other one to take this resolution & they will support. What does this means that if they can support then why they can move it themselves. This is because of their silent contracts with international players not to execute Musharraf. These charge sheets are just to de-rail the common man like us.
