Question AGE-RELAXATION FOR CIVIL SERVANTs

As per Estacode Volume-I, Chapter-III, Page 383-384 which read as under


4. Permission to be given or application to be forwarded not more than twice.-(1) Subject to the provisions of rule 3, the applications of, or permission to, a Government servant for appearing at competitive examinations at which he is otherwise eligible to appear shall not be withheld or refused, but in no case shall the applications be forwarded or permission be granted for appearing at more than two ministerial services competitive examinations during any calendar year or at more than two competitive examinations other than ministerial services competitive


This Rule of the Establishment will affect me because i am a Federal Government servant and have availed Departmental Permission twice for CSS from my Department.

The officers are adhering to the rule very strictly.


Now i want to appear in PMS Punjab. My question is that whether the above rule bans me for availing departmental permission for a competitive exam for the 3rd time or else?


Has the rule been repealed or it is the same yet. Is there any escape from this rule so that i may appear in PMS. One more thing i have to apply through proper channel because i have to claim age relaxation.


Please guide.

I think the rule bars departmental permission for more than two times during a period of one calendar year. If a person seeks departmental permission for more than two times during a year this rule will be a bar. This is what i understood and heard from people who are serving. You can confirm it from a lawyer who deals with such cases.

Dicey is right.

This rule does not affect you. It bars you to appear two competitive exams in a calendar year. It does not bar you for your whole service.

Calender year starts from January 01 and ends on December 31.

I know that rule of applying twice in a calendar year. But the issue is that the department where i work, the administration knows the Clause 4 which reads above and they refuse to grant departmental permission.

1). This calender year thing is explicitly written in Clause 4. Re-read it,

Permission to be given or application to be forwarded not more than twice.-(1) Subject to the provisions of rule 3, the applications of, or permission to, a Government servant for appearing at competitive examinations at which he is otherwise eligible to appear shall not be withheld or refused, but in no case shall the applications be forwarded or permission be granted for appearing at more than two ministerial services competitive examinations during any calendar year or at more than two competitive examinations other than ministerial services competitive.

2). Did you apply in written? Apply it in written and seek their reply in written. As per the same clause, they cannot withhold or refuse forwarding your application. If they stop and reply in written, you can go to FST or other relevant body.
