Eligibilty of President of pakistan
Eligibilty of President of pakistan:
He must be muslim. he must be 45, not less than that. for a person to become president,he must be qualified to the membership of national assembly. Article 43: the president shall not hold any office of profit . this article has been made ineffective .since it outrightly rejects any office of profit to be held by the president. The inefficacy of this article is for the time being since it is agaist the spirit of parliamentary democracy.moreover its exclusion has wider implications as it would allow every one even being incumbent, to become president . Article 63 (1)D:this article states that a person is disqualified if he holds an office of profit,except by law or statute Seventeenth amendment: this amedment has allowed the president to act simultaneously both as army chief and the president. Secondly president can dissolve the national assembly with or without the advice of the pm but that would be subject to the validation of supreme court .president after taking such step would submit the decision to court within fifteen days which will decide its validity. |
