Dear All,

I am an Advocate High Court. A couple of months ago on this forum, I floated the idea of filing a petition against the malpractices that surfaced at Faisalabad during CSS 2013. To my dismay, I did not get the desired response. However, the situation has changed in the wake of yesterday's shocker of a result ; tehrefore, it is hightime we went for a fresh writ petition against FPSC under Article 184 of the Constitution of Pakistan ,1973.

The following points will make up the petition :

1. The culprits of the Faisalabad scam have not been brought to book. They are still at large.

2. Instead of clamping down on the alleged criminals through forensic technology and booking them under the law of the land, FPSC went for a re-exam of around 250 people from Faisalabad. This is sheer injustice to the rest of the candidates who sat the exams in February.

3. How can a select number of people ( from Faisalabad) get extra 6 months in a competitive exam?

4. What surety does FPSC have that the alleged culprits did not procure the question papers of CSS 2013 exam which were despatched in the same way as the answer books were?

5. The fundamental constitutional rights of those who appeared in CSS 2013 have been violated. Clearly, Articles 9,18,25 , to name a few have been infringed. The constitution makes clear in no uncertain terms that " all citizens are equal" and expressly prohibits discrimination with respect to jobs. The Faisalabad re-exam has manifestly contravened these constitutional provisions.

6. FPSC has gone against its press release which laid down that the result would be declared by September. Hence, it has deceived thousands of CSS candidates.

7.The abysmally low number of passed candidates is unprecedented. Howcome those who were in the top 50 in CSS 2012 failed to qualify even the written part in 2013?

In view of the aforementioned legal arguments and many others which will be added to fortify the case in due course. There are strong grounds to challenge the LEGALITY OF CSS 2013 and get it declared NULL AND VOID . If I get support from those who appeared in CSS 2013 we can go ahead with this case as soon as possible since the spadework has already been done. Please remember that this is an issue of immense public importance.The more the number of petitioners ( CSS 2013 candidates) the stronger the case will be.

i totally support your initiative. its worth a try. You must go ahead with this. a lot of aspirants will join u against this shameful act of FPSC.

I support you, and also find a way to re-check the papers through a legal process in accordance with constitution/act because this css2013 result looks the same like the SPSC 2008 scandle.

Atleast we are not giving up coz we know what we have done, and what were the hurdles we faced during all this time.
I was preparing since 2009, closely looking at each papers and observing everything and have studied real hard in this attempt and i wont let it waste, i will challenge fpsc.

hum csp nai tu baqee ko kun banne dain aur woh be illegally. 6 months ka extra time kisi kee bhi kismat badal sakhta tha. we should go for the petition.finally, someone is talking sense. i strongly support you. and i would say to others.

I am also with you. The result is a gross injustice to all those serious hard working candidates who burnt theri midnight oil and this is what they get. FPSC should explain how success rate dropped to 2.09 percent only.

Come what may this result will be challenged. The matter is not whether we win the case or not but to satisfy our soul and to stretch the wrong doer FPSC before court.

Efforts should be made to strecth the checkers too with FPSC in the court.
