Default Both male and female have equal rights in rescinding a marriage contract?

A Muslim marriage is a civil contract. Both the contracting parties have equal rights in rescinding a marriage contract. Discuss this in the light of both traditional Islamic law and Pakistani Law.

according to my little knowledge

verse no 2: 229 of holy quran consult in which it is written free them with sweet will and it is not lawfull to take back from them anything.

from saying of holy prophet (pbuh) the divorce taken by jamila and habiba, wives of sabit ibn qais

Allama ibn rushad also said " if trouble on any side, other party has the rite to take divorce by man and khula by women"

dissolution of marriage act 1939 gives rite to women. Mflo 1961 also give proper procedure to divorcce woman.

i hope this is right way.......if there is any other way guide me

According to Islamic Law, both the parties have the right to terminate the marriage. Male has the right of Talaq while female is empowered with weapon of Khula to dissolve the marriage.

In given question you have to discuss definitions, capacity of both parties to terminate marriage ,essential conditions and modes (don't discuss the kinds of divorce).
Besides this you have to describe the divergence of opinion of sunni and shia schools of thoughts as well.

At the end you can conclude that the both parties have equal rights.

I believe Islam gives both parties to rescinds the marriage contract...men has absolute power to pronounce divorce while women right of khula is subjected to some grounds..
