Default summary of military courts

Parliament on January 6, 2015 approved the setting up of military courts to hear terrorism-related cases, after a Taliban massacre at a military-run school in Peshawar shocked Pakistan last month.

Prime Minister Nawaz Sharif had announced the plan after militants gunned down 134 children and 16 adults at the Peshawar school. He also ended a six-year moratorium on the death penalty in terror cases, and several people have since gone to the gallows.

The measure was approved after members of both houses of Parliament voted by more than a two thirds majority to amend the Constitution to allow for military courts to be set up. Members of two religious parties, the Jamaat-e-Islami and Jamiat Ulema-e-Islam-Fazl, abstained. “We were not taken into confidence when the amendments were being made,” claimed JUIF chief Fazalur Rehman. “The story of 9/11 is being repeated here,” he said. “After 9/11 Muslims were being targeted and the same thing is being done in the name of constitutional amendment. Some forces are trying to initiate a war between religious and secular forces in the country,” he added.

The prime minister said the law was aimed only at “hardcore” militants and the military courts would operate only for two years. Apart from the religious parties, some moderate political bodies and members of the intelligentsia have also criticized the military courts plan.

The religious parties have been enjoying a long run ever since the 1980s to determine what it means to be a ‘good Muslim’ (and thus a patriotic Pakistani), whereas the judiciary and the lawyers came into prominence after the 2007 ‘Lawyers Movement’, believing they have finally figured out how to deliver ‘true democracy’, constitutionalism and justice in Pakistan. While the lawyers are feeling insulted by the emergence of military courts.

Default

In the wake of last 16th december attack on a Peshawar school that killed 149 people, mostly students, Pakistan’s president on Wednesday signed into effect a constitutional amendment allowing military courts to try those suspected of terrorism, as part of a raft of legal changes to the way the state deals with terrorism.
Amendment to the Army Act extends the military’s remit to try civilian suspects who are members of religious “terrorist groups” for crimes including, but not limited to: raising arms against the state; murder; creating terror or insecurity; possessing and using explosives, including suicide jackets; kidnapping for ransom; and receiving funding for such purposes.
