Unhappy ECP banned fresh recruitments.(Need help from seniors)

Dear senior members.

As you know that Election Commission of Pakistan banned all kinds of recruitments in any Ministry‚ Division‚ Department or Institution of the Federal Government or any Department or Institution of any provincial and Local governments with immediate effect.

My question is that will it stop all ongoing process of Jobs?

Yes. However posts through FPSC,SPSC, PPSC,BPS & KPPMS are exempted.

Default ECP stops pre-election recruitment, uplift fund diversion

Taking notice of an alleged ‘jobs for votes’ campaign launched by some government departments ahead of polls, the Election Commission of Pakistan (ECP) banned on Monday all recruitments at the federal, provincial and local government levels with immediate effect.

According to the directive, the ban will not apply to inductions made through the federal or provincial public service commissions.The ECP also banned diversion of funds allocated for development projects and stopped the spending of the diverted funds.

The directive said different segments of the society had expressed grave concern that some government departments were in the process of inducting thousands of people to various positions which amounted to pre-poll rigging as political bribe. “…for tangible reasons the Election Commission is of the considered view that such mass recruitments at this point of time when the general elections of the National Assembly and provincial assemblies are going to take place shortly will substantially influence the results of elections. Therefore, it is imperative on all standards of legal, moral and democratic ethics that all kinds of recruitments except the recruitments which are made by the federal and provincial public service commissions be banned forthwith.”

I am not sure but yes Hiring process has been paused except public service commission jobs. It is extolling decision by ECP . This is crucial time for politicians, as they want to induct masses from their constituencies to boost vote bank for upcoming general election.

Default Ban imposed by ECP over recruitments

The ban has been imposed by Election commission of Pakistan over recruitment in federal and provincial departments except through public service commissions. I have following queries.

- The ban would be imposed over new recruitments with effect from the day when the direction made by ECP ?

- The already running process of recruitments in various federal as well as provincial departments where the written test has been taken, and even in some cases final interview has been made, would come under the ban ?

- Is not it unconstitutional act made by ECP? The speaker of sindh assembly already claimed it as unconstitutional. As per his views the ban can only be imposed after the announcement of election schedule.

Yes, prima facie both of your queries fall under the spectrum of this ban on recruitments of new posts.

It is constitutional, the ban has been imposed in the light of Article 218 (3) and 220 of the Constitution of Pakistan, which are reproduced as under;

218. (3) It shall be the duty of the Election Commission to organize and conduct the election and to make such arrangements as are necessary to ensure that the election is conducted honestly, justly, fairly and in accordance with law, and that corrupt practices are guarded against.

220. Executive authorities to assist Commission, etc.-It shall be the duty of all executive authorities in the Federation and in the provinces to assist the Commissioner and the Election Commission in the discharge of his or their functions.

Further, the powers conferred on Election Commission of Pakistan vide Article 6 of the Election Commission Order-2002 as well as Section 103 (c) and 104 of the Representation of the People Act, 1976 have also been used to put a ban on all recruitments, which were probably been made to attract people to vote for the current government to be elected as next government.

ECP has banned the fresh recruitment. In other words, if new party comes in power, all jobs will be cancelled. However, on Monday 27 January 2013 CEC is going to review his decision of ban on recruitment.
