Result Annouced Civil Judge-cum-Magistrate Exam (Sindh) 2012
Sindh High Court has announced the written result of Civil Judge cum Magistrate exam held on 20 October 2012.

I went for interview today at around 10 am.I was called in the committee room at 11;30 to appear before the four member Panel which included Justice Maqbool Baqar, Justice Faisal Arab, Justice Ghullam Rasool Korai and Justice Sajjad Ali Shah. I entered the room and offered Aslam o Aliakum. I did not ask for permission to sit an omission which I regretted later, but I remained cool until Justice Maqbool Baqar asked me in Urdu Gentleman you have science background ... you did matric in science and inter in medical, and then went for BA, why? I replied in English )))I said that I discovered soon after Fsc that I am not a man of science but of social sciences so it was a matter of personal inclination. again in Urdu, he asked me about BA subjects and then asked that what interested me most in Pak studies. but I answered in English... so he turned over to English sensing my unwillingness to speak Urdu then asked about my enrollment date and experience as a lawyer to which I replied that I was doing law practice for the 6 months. Area of Practice etc? I said Banking. He put up some questions from Banking laws, then suddenly he asked me about tress pass, I explained. and then gave a legal proposition. I said sorry sir. He asked about Res Judicata CPC which explained. Then again a legal proposition, my answer was sorry sir it is complex. then asked me about Pledge, I explained, then passed over to Justice Korai. He asked me only one question what is Dacoity but then Justice Fiasal Arab interrupted and asked whether a dacoity can be committed by 4 persons. I said No sir, 4 or 5 I said no sir it is 5 or more then 5. Faisal Arab asked me about Framing of issues procedure and whether they can be amended and what is the relevant Order. I explained. then he asked about Burden of proof and upon whom it lies. Explained. then few questions from Banking Laws. then he asked about Pleadings whether they can be amended. then he asked about dismal in default and the remedy against such dismissal. Over to Justice Sajjad. He asked me difference b/w application u/s 12(2) and application under Order 9 rule 4 something ... I explained. then asked many questions from Banking Laws. Then asked about Admission and whether Decree can be passed on admission alone. Explained. then confession and admission their difference. then asked me if the court fee is not paid what happens I said time is granted to party to do that if fails suit can be dismissed under 7/11. Kinds of evidence? Circumstantial evidence? Again Banking matters there were quick questions. there were frequent interruptions by all Justices but Justice Korai remained indifferent so was sometimes Faisal Arab. there were few other questions by Maqbool Baqar but I dont remember any now. so some questions just slipped from my mind.

JAZAKALLAH for giving such a useful information in respect of C/J interview.your area of practice is banking law? you represent financial institutions or customers ? plz if it is possible for you to share some questions related to banking law.
Can you plz recall what was the legal proposition . THANKS ALOT.. |

Customer under the ordinance is the one who avails finance facility by way of loan, and the financial institution is the one which conducts business of Banking advancing loan on Mark up basis. If after availing loan, the customer defaults in the repayment of the debt, bank shall approach Banking court filing a suit under section 9 of FIO 2001 Whereby mentioning the amount advanced, amount repaid by customer and and amount repayable, along with annexing all the documents executed b/w the parties: Agreement, statement of Account and the Mortgage agreement. Customer then shall file Leave to defend application in written statement form under section 10 mentioning the amount availed, amount paid, amount repayable and amount disputed and file all the relevant documents which prove his defense. Now hearing on leave to defend application. If The defendant raised substantial question of law and facts which need evidence then Court shall grant the Leave and proceed towards recording of evidence. But if application of the defendant has no ground, the court shall dismiss it and proceed to explanation of Break Up, which is precise account of the amount. Court shall thereafter pass a decree and attach the property which was mortgaged. hopefully it is helpful))
