dear as far as thwe prejudice topic is considered,i basically followed a papar of some maulana madudi. and he mentioned both prejudice and impact on social life separately. so i followed the suit as i felt adding more headings will be more rewarding. now coming to my strategy, basically some one here has posted a study plan of islamiat, which is quite helpful to me.i go topic wise, covering one topic at a time and then attempt the questions relevant to that topic from past 5 years (2009-2013) |

qurbanignoring the fact that i disagree with your interpretation of veil, i find your argument of this question weak. you will have to analyse it with some strong examples. i didnot cover freedom part as i have not covered rights of women so far. Q.4 Discuss the concept of veil and freedom of woman from Islamic point of view while analyzing the law against veil in France. Quran says “ and say to the believing women to lower their gaze and guard their modesty, not to display their beauty and ornaments except that what appears and to draw cover their bosoms and not to display their beauty to anyone except their husband” Introduction: eyes are the messengers of the message to the onlookers. Therefore islam enjoins women and men to lower their gaze so as to avoid immodest and indecent thoughts from occurring in their minds. Islam has also prescribed a decent dress code for women to avoid being injured in any way, physically or emotionally. however, when women do not follow a particular respectable dress code, it is natural for men to be attracted. Islam and concept of veil Islam prohibits intermixing of sex. this is based on the realistic assumption that women can be easily fall to the flattery and alluring praise of men. women are emotional by nature. such tactics can easily victimize them. Hijab is defined as the covering, hiding or to stand in between. in general terminology, it refers to the covering of head, shoulders and often face. Impact of veil: Moral degradation: it is matter of common fact that in America and western countries, level of moral degradation and chaos is very high. the major reason is the free mixing of both the sexes in colleges, hotels, clubs, ballrooms etc. Independence: it is a travesty of reality, that purdah observing women are confined within the four walls of their homes.rather, they enjoy more independence as with proper covering they can go anywhere markets, weddings, educational institutions and meet their relatives. Simplicity: women without hijab are often confused about their dressing.however, veiled women do not have to worry about such trivialities. Respect of women: the basic purpose of veil in islam is to prevent immoral practices from prevailing in the society and protecting the honour of women. as the chances of interaction with na mehram men will drop, so will the chances of violation of honour of a woman. O prophet! Tell thy wives and daughters and other believing women to draw their over them head covering a little. in this way, it is probable that they be recognized (as gentle women) and not molested. West ,veil and iqbal: West has often criticized islam for the practicing of veil, which they perceive as an end to women freedom. In west, women have been actively pursuing the goal of seeking independence. This has marred the charm, beauty and modesty of women. iqbal denounced this so-called independence of women in the following words “ jis ilm kee tateer say zan hoti hai nazan Kehte hain is ilm ko arabab-nazar maut” ( the knowledge that seeks to make woman, unwoman, wise men call it death” critical analysis of veil in islam “Say to the believing men to lower their gaze and guard their modesty. it is most pious for them and ALLAh knows well what they do ..” 24:30 The verse number 30 and 31 of surah nur has a number of implications. firstly, it has not specified veil for face. logically speaking, there is no need for men to guard their eyes and their modesty if women were ordained to cover ther faces. Even many orthodox maulvis have confirmed to the fact that the verse in no way has ordered women to cover their faces. Secondly, the verse ordains to cover beauty and ornament except that which appears thereof. this suggests that women are not forced to deliberately hide ornaments that are normally visible such as rings etc. even alazhar university of cairo has acknowledged that the veil concept practiced in many muslim countries is actually not a part of islam. The best example of veil for women in islam is the way made in pilgrimage i.e loose dress and head scarf but the face remains exposed. The veil concept prevalent in muslim countries is infact a part of their cultural norms and not religious aspect. However, it has also been specified in Quran that the wives of holyprophet are not ordinary women and so for them the order is “ to stayquietly at homes and not to make a dazzling display like former times of ignorance establish regular prayers, pay zakat and follow ALLAH and his apostle. and ALLAH only to remove all abomination from yoiu and your family and to make you pure and spotless”. France ban on veil With this background information of the Islamic concept of veil, it is safe to say that uncovering face, or working with men, appearing in pictures or driving cars is in noway prohibited in islam. France has recently imposed a ban on muslim women covering their faces, which according to them is against the spirit of secularism The fact is the government has pursued such an agenda only to appeal to the emotions of certain socialists with anti-muslim sentiments. Even a socialist hamon has expressely disapproved such a ban. according to him, although hijab is not desirable but banning it too is not approved. it should be left for muslim women themselves to decide a proper code of dress. It is not appropriate and desirable for a democratic country to pursue such an undemocratic practice. Conclusion: veil for the face of woman is not a part of islam.it is only in accordance with the traditional customs of diffrernt places. french ban on veil, though not unislamic violates basic human rights of its citizens and thus should be condemned for it. |

keeping in view the requirements of global society, determine the freedom and limitations of a muslim woman in the light of islamic teachings. "the best among you is the one who is the best to his family and i am the best among you to my family" (hadith) introduction In the midst of darkness of ignorance that englufed the entire world, ray of hope emerged in arabia with the divine revelation. Revealed by the creator himself, the religion considers the requirements of an individual, man or woman in all the sectors of life, collective or individual. Quran says, " o mankind, keep your duty to your lord who has created you from a single soul and from it created its mate and from them twain has spread multitude of men" Economic status of women in global world a) Economic freedom islam recognizes the right of ownership of women to property and women.unlike many pre-islamic religions that forbade women from economic independence. islam, on the hand accepts the right of women to sale, purchase, lease and other similair transactions. islam also accepts the female right to inheritence. it is stated in QURAN: " to men belong a share of that which parents and near kindred leave and for women a share that left which parents and near relatives leave- whether it be small or large- a determinate share." islam also permits women from seeking employment and doing jobs, athough it regards the prime position of woman as a mother and wife with great respect.particularly,if the employment suits the very nature of a woman, and it is beneficial for humanity, such as nursing and teaching, then islam in noway obstrcsts the woman from working.. b) Economic limitations it is a fact that in most cases the right of inheritence of a woman is half to her male counter part.this,in no way suggests the status of woman in islam. rather, this is in accordance to the difference in the financial obligations of men and women. in addition,a woman as a wife is entitled to right of mehr as a token of consideration. II) Political status of women in global world a) Political freedom islam encourages participation of women in political affairs.even a cursory glance at the islamic civilization reveals the fact that women took part in discussion relating to public affairs and even argued with HOLY PROPHET (p.b.u.h). islam acknowledges the right of women to cast vote and even be nominated to political positions. during the period of caliphate of caliph umar,a woman argueed with him, proved her point and even caused hazrat umar to declare, " A woman is right and umar is wrong" Political limitations although not mentioned in Quran, but interpreted from a saying of holy prophet is " people will not prosper if they let a woman be their leader" this,in no way, is an attack on the integrity of a woman.rather, this is in accordance to the physical and psychological nature of a woman and the duties assigned to the political head of the state. islam, does not consider, the political leader as a mere figure head. infact, a political head has to lead prayers, particularly friday and other festivities. similarly, a political head has be intensively associated with designing a security strategy. women, on the other hand, undergo psychological changes during monthly menstrual cycles and pregnancies.this can affect their decision making abilities. Social aspect of women in global world a) as a daughter islam ordains muslim men not only to protect their daughters from female infanticide, but also to treat them fairly and gently. holy prophet (p.b.u.h) said " he who has a daughter, and he does not bury her alive, does not insult her or does not favour his son over her,ALLAH will enter him into paradise" at another place " whosoever supports two daughters till they mature, he and i, will enter day of judgement like this (joining his two fingers) b) as a wife islam has legalized the union between man and woman in form of marriage as a means to physical satisfaction and to ensure mental and emotional harmony. keeping in view the physical and psychological nature of males and females Quran says " and they have rights similair to those of men over them and men are a degree above them" islam also acknowledges the right of a woman to refuse an undesirable match. once, a woman came up to holy prophet and complained that her father had married her without her consent. holy prophet called up her father and asked the lady to agree or refuse the marriage. mehr, the token money, given to the bride in consideration of marriage is a right of a woman granted by ALLAH. c) as a mother islam enjoins believers to obedience to parents, next only to worship of ALLAH. Quran says " your lord has decreed that you worship none save HIM, to be kind to your parents limitatations of social status of women the absolute right of divorce, lies with man only.although women, too have the right to seek divorce through khula. this difference is the result of the emotional nature of women. the superiority given to men over women, in no way aims at disregarding woman but considers the emotional nature of women to seek protection. conclusion: islam has provided women with freedom keeping in consideration their physical and psychological nature. |

Quote:
Qias literal meaning is to make analogy or to compare something. Qias is the principle of Islamic Legislation in which law is made by comparing the "effects" or "cause" of the common things. For example Alcohol is prohibited in the Islam. But if we talk about the cigaret ,is it prohibited or not ?we do not found any instruction about it in the Quran and Ahadith. now to check if either the cigaret is prohibited or not,we compare the "cause" or "effects" of both. Alcohol is intoxicant and cigaret is also intoxicant so by comparing both Ulema issue fitwa that cigaret is prohibited in Islam. As far the Ijtehad is concerned it is the mechanism of using one's intellectual and mind to make the law. it does not concern the common consensus or analogy. jurists and judges by himself decide during the decision making. All IJMA ,Qiyas and Ijtehad are used when the instructions or commandments are not found in the Quran and Ahadith. Thanks dear able to understand me for this. I think it will be enough for you. If you do not understand then you can ask me again. |
