Assalam-o-Alikum!

" In my view, for a general study it is enough to go through a general book first like that of Cheema on Mercantile law, for the very first thing to do is to cover all the topics. This should be followed by a detailed study of specific questions and solving of the past papers should be the last thing. Anyhow, to enhance academic quality, you are further advised to go through Schukla's Mercantile law.

Now a word about the contents of ML. My perusal of the past papers has revealed that the subject caters to six laws namely:

1. Law of Contract;
2. Law of Sale of Goods;
3. Company Law;
4. Law of Partnership;
5. Law of insurance;
6. Law of Negotiable Instruments.

Moreover, you can and you should, for the sake of better approach also see the original statutes in which all these law are codified. Finally you should start with law of Contract, which is mother of all the laws stated above."

For Kashif Iqbal: Mercantile Law

Dear Kashif,
Assalam O Alaikum,
Nice to see people with optional courses related to Business. I also opted Mercantile Law this year. But was quite uneasy while dealing case study type of questions. I would be extremely happy if you kindly to let us know your technique of solving case studies.
Further please throw light on few of my following queries.

1. Is there any definite answer of case studies. For example in recent paper's case study(Hassan Seed VS Fahad they asked whether the seeds were accepted or properly rejected? So does one have a specific answer? What was your answer in this case?

2. If your case answer seems to be wrong will you loose all marks or there is any way one can get few marks if one has proved one's point through correct arguments? In your previous attempts(if any) did you wrote any incorrect answer to the case study and what was the result?

3. In your case study answers did you include Provisions, Case law example etc...What exactly you put in your cases to get good marks?

4. Is this course is like mathematics e.g if your case answer is right than you will get marks otherwise no marks will be awarded? What is your experience.

I know my querries are too many but I am really worried about my this course...I dont whether I have attempted it correctly or otherwise because whole paper consisted of case studies really put me in the dilema.
Please find time to answer my querries.

Dear Hassan Asslam-o-Alaikum,
Hope u ll be fine. U r right dt the style of Mercantile Law paper which FPSC has introduced from 2002 is quite technical n now the person with deep study of the subject can attempt the paper which is based mostly on the case studies. I appeared in css exams last year too wd the same subjects hard luck for me dt i got failed in English Precis paper wd only 1 mark despite dt i got realy good marks in all other subjects including Mercatile Law in which i got 81. This is mainly due to the reason dt I did B.Com n MBA n during my masters we were given case law studies same as r been given in css so i wz familiar wd the style already which wz quite helpful for me. my method to attempt wz dt first of all i just replied the case n try to explain it wd the help of relevent area of all n after dt i described other relevant situations of the law. my answers were not very lengthy as i saw many candidates using lots of sheets but despite that by the grace of Allah i managed to get quite good marks. Now to ur querrie Law is termed to be a common sense so any person can expain it in his own way as he perceives it but he should give strong arguments to support his view same is the case wd the Mecatile Law paper of css. this paper is of course not like mathematics dt whether its correct or wrong its like all other theoretical subjects but of course if u ll narrate a complete irrelevent story u ll not get marks for dt. I mentioned sections of the law n also the case laws related to subject case n this is only tenchnique by which u can have good marks in this subject. if u ll just concentrate on ur own expalainations n examples u ll get average marks in every law subject its not only specific for mercantile law only. I hope i hv cleared ur all queries as far as i can but if i hv missed any or u hv any other plz dont hesitate to write again i ll e happy to help u out as far as i can take very good care of u n best of luck Allah Hafiz

hi beenish
well u have to study 2 books for this course
1.business law by khalid cheema
2.company law by lauqman baig

u ust read these book extensively and make ur own points, M.Law is common sense mostly and these books will carry u through after this try to solve the question papers. there is no definate answer its the way u sole it.

i am a b.com student we study business law as a subject in which we study contract act,negotiable instruments,sales of goods act,carriage of goods act,industrial law and other topics so the main reason for typing all this is that i had read the book from khalid mehmood chema and its not that good even for b.com in my humble opinion you should purchase the book written by qazi awais this is a good book with plenty of material and headings too

....do case studies a lot bec it will make u able to solve theoretical and case based questions as well.....last time it was all theoretical except one question. select a good book that had many solved case illustrations.....n best of Luck!

Remember one thing. guides are for stupids. only focus on statue book and reproduction of law in you own language with illustrations and case laws if you can memorize. Key of impression to use legal language and terminology.
