Unhappy Muslim Law is Difficult.

Hi friends,

I am in desperate need of your help.I had opted Muslim Law subject after careful consideration as i thought this was quite easy and interesting. But after studying lots of books i am not able to comprehend this subject as i had thought. The Inheretance chapter is quite tough and i am not sure that i will understand it.But the main problem with me is that the language in Mulla's book is quite impossible to comprehend.
I don't know what is the method of studying it.
I have one more question that all books like Faizi's,Mulla's and Abdur Rahim's books are written in Indian context. There is nothing like Pakistan' case references and court rulings etc. Please tell me do we have to write our answers in Indian context.
Please help me as this is my last cry for help otherwise i will leave this subject and will opt Sociology which i think would be less technical like this.
I am waiting for your help.God bless you all.

The same problem I had faced as you are now facing. One of my friend told me that to comprehend the jurisprudence language you must be a lawyer or atleast have some background in law. Interestingly I also opted for Sociology.

Muslim law is not difficult rather it is more technical...there is a key book of Muslim law by "MASOOR BOOK LAND".try to consult that book is is not only easy to understand but also good for saving the time as it is written in very comprehensive form.

Brother my experience with sociology was much better as socioligy is much easier than the technical jargon of law. I have consulted only one book for sociology i.e. Horton and Hunt. This book is excellent and much easier but a bit bulky. A shorter version of Horton and Hunt is by Abdul Hameed Tiga. So if you want to understand sociology you need to consult Horton and Hunt and in the days of exams when you have short time you can consult Tiga's book.

Regarding advice to you, brother you can be a better judge by simply studying the above books and then ask yourself which one is easier. In my case sociology is easier.

@ Hina,

Hello, Hina i have prepared Muslim law from F.D Mullah and M.Asif Malik, Problem is I want to know how to attempt this paper? In question paper 2009, Question # 2 Is about Musha Gift,According to my little knowledge answer of this question cannot extend more than 2 pages. But, Are 2 pages are enough for 20 marks question?

Please kindly solve the mystery of solving this paper, How to attempt?

Question

Thanks Hina,

I have a question that in past years papers i have noticed that questions have
come with modified form i mean they are not directly asked. If we prepare from
these books then we have quite direct questions but in css past papers the questions are not that direct. And i think if we are not able to understand this subject properly then i think it would be trouble some for us in paper.Because for
answering indirect questions we have to know the depth of this subject.
The questions on gift and inheretance are quite indirectly asked.
Please tell me can we take the risk of skipping inheretance part.
And please tell me what to do with that so much case references in Mulla's book. Do we have to study each and every case reference in it.
Please help me.God bless you.

well for the purpose of attempting any question, one have to make a proper sketch.lets suppose you have been asked of MUSHA GIFT,then common sense requires one to firstly give a brief and proper introduction then to mention as what is gift and its essentials etc, because you can't directly jump upon MUSHA,so you have to answer in such a manner that if you are letting layman know of it.then mention as what is MUSHA and then its kinds.you can better extend it.i hope i have answered your query...

you are firstly required to clear the concepts, once you are done with it only then you will be able to attempt those even indirect questions well.As what is the basic difference between will and gift and what makes transfer gift and not wqf etc and what is the limit on donor regarding transfer of property.

any other query?
