1. Musnad has 40,000 hadiths for sure
2. ILLA means when Husband swear to Allah for not having cohabitation with spouse for a proposed period of four months or so, he is said to have made ILLA so the correct answer was NONE of these. 3. The limit of testamentary power of a Muslim is 1/3 for sure. 4. Answer of 12 is (b) is correct. Moreover, Parliament cannot be used for consensus of opinion because of many reasons. I have solid arguments. It was a question from last year paper. I attempted this question and secured 76 marks. |

thats funny, because last time i wrote that parliament could be used to make consensus and i got 67 and i only got 5 objectives right at that time.

see its all about how you tackle the problem, few of my logic was given in the previous posts. An additional reason is that in this modern era where would you find such a representative body cable of representing a major part of the population. People are divided into different sects, one sect doesnot trust the other. Parliment is that platform where all the people could come together and make laws. Furthermore i clearly explained that in relation to religious laws the parliament could easily get the help of well known jurists. Furthermore there are institututions which help and provide assistance to the legislatures in making laws, not only religious laws but also political laws. All the islamic laws the muslim family ordinance 1961, marriage act and other laws were all made in the parliment. One must remeber that the other name of pakistani parliment is shura.

But consensus of opinion does mean Ijma. Our parliament is, by no means a Shura, but the fact remains Ijma is done by Mujtahids. Do the members of Parliament (shura) possess such qualities as required for consensus of opinion? Moreover, Ijma is done once and when no contradiction takes place according to whatever schools of thought, but here we see continuous remaking of laws until they best fit their personal interests. Moreover, Fatwa emanating from Ijma must be world-known or well-known, but the decisions of Pakistani parliament are neither world-known nor well-known. We don't find even a single member who has similar qualities as of a Mujtahid even the interior minister does not know how to recite Surah e Ikhlas. |

with all respect i beg to differ,
Again the discussion is taking us to ijtehad and qualification of a mujtahid. Ijetehad is a totally different concept and ijema making of consensus is something different. Secondly i beg to differ regarding the changing of laws. No doubt ijmaa cannot be questioned by an individual jurist. Except for the ijmaa made by the companion of the prophet all other ijmaa may be reversed or modified by the ijmaa of the same or subsequent age. And as i have mentioned earlier in parliment the laws are not necessarily made by the legislatures. They use the assistance of mujtahids experts of the field. The people who understand islam. Basically the laws are made with the help of experts, but presented in the parliment for consensus. Do you think are parliment is smart enough to have made the muslim marriage act or the muslim family ordinance, or mercantile law or international law. No without a doubt they are not, but they get assistance from experts, thats why there are posts for technocrats, experts in the government. We are talking about a platform and this era without a doubt parliment is the one. could you name any other institution which would be so widely accepted and whose laws so widely followed (constitution) other than the parliment. I differ here dear. Ijma is made with the help of mujtahids. Is it possible to make ijma with the deducing powers of ordinary and most importantly corrupt people? Anyways, i wish u all the best.
