This is ridiculous. If people keep on filing writs then it means result will not ever be declared. They should just declare the result and then may handle any writ petitions. That is what every organization does. They do not let others hinder the work.

this is what to be done n I think thats why they are saying that result will be announced in this week (even if stay from balochistan) ...

Okay guys the important thing.....


Firstly, the stay from the balochistan HC seems to be a news, and has yet to be authenticated. If such was the case that there was a stay in field, it must have had been in the notice of NAB earlier and would have had been conveyed to many of us our info giving nab official friends.

The lawyers of NAB who were giving me info about the IHC petition, were informed by me about this Balochistan stay thing, i.e. they came to know about it from me and i read it from this forum, which shows that the HQ seems to be unaware of any such stay because if it was there the lawyers should have its info, but again possibility is that this being from another province, may be lawyers of NAB in Balochistan are working on it ?? Anyhow, i have requested them to check on it and update soon.

In addition to the above, i got to an AD from lahore who was among the petitioners, he was saying that he doesnt know about the stay from the BHC but was said that there was some stay from another province, which ever, and at the same time the petitioners were planning to knock the doors of the August Supreme Court against the dismissal order dated 31.01.2013. seeming thereby that he was also not sure about the stay.

After talking to him, just called a DD at headquarters again who was among the petitioners, he said that he was unaware of any stay and the letters were expected to be issued in a weeks or ten days time and was also not aware of the going to SC.

On my own part, i checked the BHC website for the cause list but the site isnt working. I'd request our friends from Quetta, specially the lady who works in the bank and in end December there were rumors on the forum of her getting the letter and she surfaced to rebut those rumors, to please use your connections and check with the BHC (banks have lawyers on their panels, you can ask any of them ), consult some friend lawyers so that they can dig out any such petition. Or simply go there and you can find agents there who can charge merely 1000 or 1500 and they will get you the attested copy of the whole file, but in this case they might charge a few bucks extra as they will have to dig out the petition because we have no number etc of it. In the meantime i am also trying to access lawyers from BHC but as dont have anyone directly there.

Out of the above divergent pleadings and arguments i am of the view that:

BHC: the stay from BHC still seems to be a vague report until authenticated by anyone who has seen the petition himself or we get the W.P number of it . Even otherwise, if there is a stay, it presumably should be within the jurisdiction of BHC, and other provinces should not be affected by it but you never know. On the other hand, making the IHC judgment the base of the argument, the stay can be vacated easily.

Moving to SC: About the aggrieved petitioners from the IHC moving to SC seems plausible but getting a stay does not seem easy as the judgment has been passed by the CJ in very detailed manner touching almost everything. I dont think the SC shall grant stay without notice to the other parities: literally meaning that they will first issue notice to NAB and the estab div etc and then will hear them also and then will grant of refuse the stay.

Letters: I think we should expect them in a 10 days period as that is what mostly we are getting info from sources as well as nab info numbers.

ECP ban: has been lifted on hiring in constitutional institutions, president, pm, judiciary, ecp, fsc, army, parliament, governors etc. NAB in my opinion does not fall into it as being result of a special legislation. BUT!! 25 institutions has filled references on which the ECP says that it will decide on case to case basis, hence we seem to have a prima facie case, balance of convenience is in our favor and if not given the jobs we are expected to suffer irreparable loss which the the three contents of a stay and all are in our favor and seems that ECP shall allow these posts to be filled.

Opinions and suggestions are most welcomed.
