Although some of the serious flaws in the draft law have already been reported by The News on Tuesday, the bill’s provision related to “Voluntary return” is really nasty one as it suggests the escape route to the corrupt even if he is caught at any stage.
According to clause 18(1) of the draft law, a looter and plunderer if voluntarily returns the looted money prior to the filing of reference he could get away without any liability.
The said provision reads as:
“18. Voluntary return, etc.- (1) Notwithstanding anything contained in section 17 or in any other law for the time being in force, where a holder of public office or any other person on his behalf, prior to the reference has been filed or trial has commenced, voluntarily comes forward and offers to return the assets or gains acquired or made by him in the course, or as a consequence, or any offence under this Act, the Commission may accept such offer after determination of the amount and deposit of such amount as directed by the Commission and shall discharge such person from all his liability in respect of the matter or transaction in issue.”
The above provision allows enough time before the filing of a reference to the plunderer of national wealth to return the looted money without any penalty. Before the filing of a reference, an inquiry into the matter is ordered following which a proper investigation is initiated for which the accused persons is also confronted. Only after the inquiry and investigation, a reference is filed on the basis of documentary and other evidence, which means that the plunder of the public money had the opportunity to get off the hook only after he was sure that the evidence against him is concrete and irrefutable.
In case the plunderer of national wealth does not return the looted money before the filing of the reference, he would have the chance to do it after the filing of the reference and during the trial even but such an option would bring a minor punishment for him i.e two years disqualification to become member of the parliament and in case of civil servants dismissal from service.

I think that is extremely baised and farcical bill that makes mockery of accountability. This should be challenged in the supreme court. Allah Hafiz hy iss country accountability ka k iss tarah k bills ban rahy hein.

So, it proves the person we elected last time, he cannot defend right things. Infact, that very person is a silent witness of all the corruption being done. No matter in government or in opposition, all bear the same responsibility. How insane this nation is. Corruption is legalized after it is done and there are only few who speak against all wrong doings. And time has changed yet people are the same. Corrupt are still doing corruption and now even legally.

Yar kahin hiring main politicians ka quota to nahi rakh dia new bill main?

A friend of mine working in NAB told me that today NAB Headquarter has directed all regional NABs to start interviews of JIOs, ADs and DDs on 20 & 21 Octobers. These days are saturday and sunday that are NAB holidays. But they will continue to work to complete these interviews. That is 101% correct news. Congratulations dear friends
